Ya gotta wonder if the Feds are daring the appeals court to call their hand on Padilla. I am beginning to suspect that the prosecutors will now say: okay, ya want charges? well, here they are. Yet another December Surprise for our side.

As long as they file charges, keep him locked up. I find a big difference between keeping foreign combatants locked up as POW's, and holding american citizens without charges.
It is unamerican to hold somebody without being able to see a lawyer or hear the charges against him.
If they have the goods, charge him, otherwise he must be released. The court was right here.

Your theory may be true but I don't think so. It seems to me if they had credible evidence he would have been charged. There could be a national security angle to making charges public but there are legitimate ways to deal with those concerns.
I don't like the idea of the gov't holding people without charges. I may be delusional but I like to think there's still some shred of respect for the Constitution left.

The idea of holding an American citizen indefinetely without charges is horrifying to me.

I hope the FBI will be shadowing him, tapping his phones, etc. Let’s see who supports him when he is released.
Wait and see where he leads us. If this release enables us to catch some other terrorists it might not be too bad.
