The law isn't perfect yet, else innocent disabled people wouldn't be starving to death in the presence of police guards in the United States.

Can you not grasp the far-reaching effects this has, the potential for it to be a landmark case in the fight FOR euthanasia?

You say nothing can be done - I bet lots of Germans said that when their Jewish friends and neighbors were taken away. Those same Germans were no doubt a little taken aback when they came for the old, disabled, disfigured and mentally impaired.

Do you not see where this is all going? What's that old adage...they came for the Jews, Christians, I said nothing etc...then they came for me.

You said in a later post that the rule of law was followed. Just because it is law, doesn't mean it is right. Slavery was once legal. Abortion is legal now. If tomorrow a law was passed saying that it's ok to euthanize anyone over 65, anyone who can't feed themselves, anyone who can't recite the alphabet, run a mile, would that be ok because it is law?

You also asked if posters would be willing to pay her hospital bills. That's a moot point. First of all the hospice where she stays hasn't been paid a thing (probably because the husband's lawyer was a board chairman there), and also, her parents have said that they will pay for any care she needs, they just want to take her home.

Do nothing? Resign ourselves to the inevitable? I guess this country is run by a few judges then. So much for we the people.

DISCUSSION



I. Authority To Issue Executive Order



The governor of the State of Florida possesses authority under the Florida Constitution, Article IV, Section 1(a), to see that the laws are faithfully executed. Section 943.04 authorizes the governor, upon written order, to direct the Department of Criminal Justice Investigations and Forensic Science (“Department”) to “investigate violations of any of the criminal laws of the state.” In Thompson v. State, 342 So.2d 52 (Fla. 1976), the Florida Supreme Court upheld the authority given to the governor under Section 943.04, saying “[t]he power to see that laws are faithfully executed, which is essentially what Chapter 943 is designed to achieve, derives from Article IV, Section 1(a) of the Florida Constitution.” Thompson at 55.



The brief filed by the Governor in the Middle District of Florida sets forth significant reasons to believe that Section 782.02 is being violated because “Terri’s right to life is violated by the state when the state, acting as her guardian, assumes that her wish to live without artificial sustenance is the same as a wish not to be fed at all. The state has an ‘unqualified’ interest in life.” Brief at 5. Moreover, Terri is being denied oral sustenance, which creates “an unnecessary conflict with Florida Statutory law by implying that physicians may cooperate with a person’s alleged express wish not to feed herself . . . .” Id. at p. 6. A denial of Terri’s right to life under these circumstances, it appears, results in a violation of Section 782.08.



The laws of the State of Florida, then, as set forth in the Governor’s brief, are not being faithfully executed. The authority of the governor to issue an executive order in this case is consonant with his duty to see that the laws are faithfully executed.





II. An Executive Order Does Not Impugn the Authority of the Court



The trial court order merely authorized Terri’s husband to direct that oral sustenance be denied her. An executive order that orders an investigation in this matter, with the concomitant appropriate actions that would be taken if a violation of Section 782.08 is found, does nothing to impugn the authority of the court. The executive order would ultimately operate only upon the husband’s decision which he is merely permitted to make. It is interference with private discretion, not with judicial authority. If the consequences of the husband’s exercise of discretion are determined to result in the unlawful taking of life, it is entirely appropriate that such actions be interdicted by law enforcement at the direction of the governor.

Okay, for the sake of argument, how much money are you willing to pay towards her hospital bills?

If that question is not to your liking, just who shall be responsible for maintaining her?

Her parents want to take her home and, apparently there are doctors who believe that therapy will help her. The husband has blocked any therapy. He's even blocked antibiotics when she's been ill. This isn't such a "cut and dried" issue at all.

I did not say that.

What I said was "Perhaps I am missing something here, and I don't mean to sound cruel and uncaring, but has the rule of law not been followed?"

I asked a question.

Suffice it to say I do not.

IMHO To equate this with the proverbial Germans VS the Jews, slavery, abortion, et al. is but flack thrown in the face of reality as it concerns the Terri Schiavo situation.

I will end my comments with this. Terri Schiavo's situation is very sad, however it will not bring about euthanasia for the masses, the Germans won't be executing Jews in the near future, and slavery will probably remain active only in third world countries not in the U.S. .

There were legal documents indicating that JEB has some legal grounds to issue an Executive Order.

Let's pray that he will do so ASAP.

Call local hospices (be nice; there ARE good people out there) to express concern about Terri -- I did. Turns out they'd gotten email updates from Terri's hospice.

SPOON campaign -- her mom would be GLAD to spoon feed Terri -- something her husband has denied her! (inspired by Kimmie7's earlier idea) -- send in plastic spoons -- if I do come, my sign will have spoons attached & will pass them out.

I won't strawman you over the head but I am curious, is she indeed comatose?

I'm no doc but she does not look comatose to me. She does look quite brain damaged and unable to feed herself but is that comatose. She is not on a respirator and appears to respond to some stimuli.

I'm not saying she will ever recover but can we kill her because she is in a twilight of sorts and unable to feed herself.

Also, why will the husband not allow her parents to take over as her guardians since they have asked for that?
