MIAMI — The Florida woman who shot and killed a drugged-up Army vet in a spat over a parking spot at a Walmart will not face charges after he threatened to ‘f— her s— up’, prosecutors revealed Thursday.
Bart Diguglielmo, a 62-year-old retired staff sergeant, was fatally shot in front of the supercenter in North Lauderdale just before 12:30 p.m. on June 30.
The shooter, identified as Melissa Payne, is immune from prosecution because she acted in self-defense due to the state’s “stand your ground” law, the Broward County state attorney’s office announced.
One witness said she had heard Diguglielmo threaten Payne before the shooting by saying “I’m gonna f— your s— up,” while another said he told her hew was going to “mess her car up”, a legal memo stated.
“Florida is a Stand Your Ground State,” prosecutor Stephen J. Zaccor wrote. “MP (Melissa Payne) did not have to wait to be attacked before resorting to deadly force.
“She did not have to retreat as long as her fear was reasonable and no evidence has been presented to disprove that.”

Bad situation, but given those facts, I have to agree with this decision.
Perhaps we could retroactively thank him for his service?
kudos to Melissa for defending herself from a drugged-up asshole harassing and threatening her and refusing to stop advancing on her even with her threatening to shoot him if he didn’t stop moving towards her ... if she had chickened out, he likely would have beat the shit out of her and perhaps even shot her with her own gun ... hopefully, incidents like this might make folks think twice before harassing and threatening other folks for dumb shit like parking places ...
Retiring as a SSG, unless it was medical related, is not a glowing endorsement of a military career.
I have weak expectations that this incident will deter anyone else from bad conduct.
Maybe.
But it is 100% effective at preventing recidivism.
