An affidavit? Naming the driver?

How about the fact the government bears the burden of proof that you are the driver? You have the right to remain silent.

The government has to prove you were the driver. Period.

In Texas a Red Light Camera ticket was mailed to the owner of the car. Much like a toll pass bill.

Until Texas wised up and overturned the Red Light Camera ticket laws.

Funny thing.... My son was driving my car last year and probably went through a yellow to red light in Leon Valley.

I get a ticket in the mail from some company in I think Arizona.

File 13. Unenforceable and uncollectible.

I always thought the state/law enforcement/whatever had to prove you guilty rather than you proving your innocence. Guess that’s one of the problems with a traffic camera. I’ve heard about this problem too many times now. Happened to a friend of mine. He was home in Nebr. & a traffic camera in Washington supposedly caught him in a violation. That’s REALLY screwed up, but he finally came out of it.

The fact they can’t prove anyone was the driver is why these don’t get applied to anyone’s driving record. So its a risk they’re asking us to accept if we loan our vehicle out.
