Obtaining a change of venue for the Cole Allen trial(s)

Cole Allen will be indicted on multiple charges. His alleged crimes occurred in Washington D.C. and he will be tried there. He will be found not guilty there, by reason of Trump Derangement Syndrome.

Washington D.C. is the most Trump-hating place on earth. It, along with the surrounding communities in Virginia and Maryland currently have an unemployment rate of 6.9 percent, largely due to doge cuts under the Trump administration. Prosecutors must realize the entire jury pool is tainted with anti Trump folks and they will not find impartial jurors. Even worse, the judge will be anti Trump.

It is imperative that Jeanine Pirro get this trial moved out of the area, maybe to downstate Virginia, like Norfolk. Also, if Cole Allen drove from California to Washington D.C. he crossed many jurisdictions where he could be indicted for carrying weapons used to commit crimes. He should be tried in these jurisdictions also. If he drove through Missouri for example, a federal prosecutor might be able to prosecute him there.

The venue can be wherever the crime began, continued, or occurred.

So, you could charge him wherever he bought the shotgun, which is likely somewhere besides Washington DC

Yeah I was on a federal grand jury for the better part of a year plus a couple matters that hung on for 18 months. Serious time suck, but I have a very solid handle on federal criminal procedure.

Lots of drugs, human trafficking, motorcycle gangs, and really weird espionage things out of Roswell/white sands.

Don’t trust any Chinese H1B people with anything. Every one of them vacuums up every thing they can remotely find about anything and sends back to China.

It will be same as Iryna Zarutska “trial” - the perp will be found too mentally ill or incompetent to stand trial - sent to an institution for a few years and then quietly released:

“Decarlos Dejuan Brown Jr., the man accused of killing Iryna Zarutska, has been found incompetent to stand trial in state court.”

Sadly, you are most likely correct. I recall when John Hinkley shot Ronald Reagan (along with a D.C. police officer and James Brady). Brady eventually died from his injuries.

I told someone at the time that there is no way a D.C. jury would convict an assassin of a Republican president. Of course, Hinkley was found not guilty by reason of insanity, and walks free today.

Article III Section 2 Justiciability Clause 3 Trials The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed.

Federal Rule of Criminal Procedure 18 Rule 18. Place of Prosecution and Trial Unless a statute or these rules permit otherwise, the government must prosecute an offense in a district where the offense was committed. The court must set the place of trial within the district with due regard for the convenience of the defendant, any victim, and the witnesses, and the prompt administration of justice.

For change of venue, it requires “great prejudice.”

Rule 21. Transfer for Trial

(a) For Prejudice. Upon the defendant's motion, the court must transfer the proceeding against that defendant to another district if the court is satisfied that so great a prejudice against the defendant exists in the transferring district that the defendant cannot obtain a fair and impartial trial there.

Placing an early bet that worthless AG Todd Blanche will do ZERO about a change of venue, which should be priority number one. He’ll do no more than appear at news conferences

In fact, this case will be delayed long enough that if a Democrat is elected president, the charges will be dropped or a plea deal struck ordering the suspect to undergo extensive mental health treatment so he can be reintegrated back into society.

Yes, the Constitution requires the trial be held in the district where it occured.

There is a small chance that one juror might hold out for a guilty verdict but you are likely right. And if that were to occur, I think much darker things might follow. There are a lot of people who would be upset, to say the least, that a Trump-hating jury would let a would-be assassin walk free.

The defense team may try to get him off on some sort of technicality so a Not Guilty will be more palatable.

What sort of ‘technicality’ could there possibly be that would move a judge (even a DC judge) to dismiss the charges?
