Under North Carolina state law, a defendant is only incapable to proceed to trial if they cannot understand the nature of their charges, cannot comprehend their role in court proceedings and cannot help their own defense.
Brown's attorney Daniel Roberts said the murder suspect underwent a capacity evaluation in hospital in December which he failed leading a psychiatrist to determine he is unfit to face murder charges.
Zarutska died after her throat was slashed as she sat alone on a train in Charlotte, North Carolina in August 2025.

You are not supposed to understand that defense. It is how murders can get to murder again, and again, and again, and again, and again. Until they die of old age.

This is even worse. I can just hear his lawyer. “Judge, my client tells everyone he meets how he sliced that white b*$%* up, and will continue to do so in front of you and the jury. That, by definition, will not be helpful to his defense, and therefore he cannot stand trial.”
so if you want to be an evil mastermind and be a serial killer, when you go to trial, do like Tom Hanks and pretend your nose is stopped up like in Forrest Gump and you can get off.
He was smart enough murder her. He obviously knew what he was doing. The vide from the transit authority proves that. His own words on the video prove this opinion is vacuous.

So what are they going to do with him?
The guy has a life-long history of mental problems. They knew he was nuts when they released him from prison in 2020, allowing him to rack up more arrests. In January 2025, he was arrested for abusing the 911 system and then released. In July 2025, a Judge ordered a competency test conducted on him, but it was never done, and he remained free until he stabbed Iryna to death. People knew this guy was a nutcase, but they didn’t think it was important enough to incarcerate, or admit him to a hospital psych wing so that a competency test could have been conducted when the Judge ordered it. It might have saved Iryna’s life.
I have no idea, but the logical thing would be to lock him up in mad house forever!

Exactly. He was coherent enough to pick of all the people on that train the victim least likely to fight back effectively. He knew what he was doing.

Yeah, then the people who let this monster roam the streets should be put on trial instead.
