The Trump administration is suing California over a de facto fuel economy rule that it believes the state is using to an enact a pseudo electric vehicle mandate, the California Post has learned.
The Department of Justice filed the lawsuit Thursday on behalf of the National Highway Traffic Safety Administration (NHTSA), arguing that the Golden State is violating federal law by forcing state-specific mileage requirements on car manufacturers through the state’s Advanced Clean Cars proposal.
“California is using unlawful policies from the last administration to create exorbitant costs for their citizens — this Department of Justice is proud to stand with President [Donald] Trump and Secretary [Sean] Duffy to bring litigation that will make life more affordable for American consumers,” Attorney General Pamela Bondi said in a statement.
A statute under the Energy Policy and Conservation Act prohibits individual states from adopting regulations related to fuel economy, however, California has received several carve-outs dating back more than a decade.
California Gov. Gavin Newsom took advantage when the California Air Resources Board (CARB) adopted Advanced Clean Cars II in 2022, which required an escalating percentage of new passenger and light truck sales to be zero-emissions, until reaching 100% by 2035. Then-President Joe Biden’s EPA granted California a waiver to enforce the rule.

What is it in California?
The air, the water, the education system?
They have a real problem perceiving reality.
They have destroyed their electric grid in the last 20 years.
There is no possible way that California’s grid can support an Electric Car economy.
Just a hot spell puts California in to rolling blackouts.
Valley fever (coccidioidomycosis).
How many cars are manufactured in California?
Screw them. Ignore the state and their stupidity. Make cars for the rest of us. They can force their own residents to deal with it.
California’s vehicle environmental mandates have been a long-term violation of interstate commerce laws and interference with the federal EPA. The rest of us have had to suffer for decades with over-complicated, poorly designed cars and trucks to meet some CA whackos’ vision of “clean” transportation because they don’t like how the LA basin traps exhaust fumes.
Tesla Fremont. There may be some low volume companies. I don’t think the majors assemble cars in California any more.

They actually have a problem of wanting to tell everyone else what to do. Sort of a “Tyranny of the 51%” syndrome. They’ve gotten away with this stuff since the 1970’s

So, if they are setting “local” CAFE rules, they are running afoul of the Interstate Trade of the Constitution.
CAFE is not applicable to EV, only RICE.
Trump’s EPA should be able to overturn Biden’s EPA rule making.
The rules in question are about cars sold in California, not made there. Enforcement of the rules forces car makers to either make California compliant models, or not sell some cars in California. So yeah, the state is usurping regulation of interstate commerce.
Or too much Ecstasy in the 80-90s.
Who ever is building cars in California. Move out. And don’t ship any new cars there.
