MEMPHIS, Tenn. - The former CEO of Evolve Bank sought sex from someone he thought was a 15-year-old boy whom he met on Grindr, according to court documents submitted by an FBI agent.
The FBI agent said that they signed onto Grindr on October 19, 2025, and pretended to be a 15-year-old boy. They said they received a message from someone on Grindr going by the name "Tomm." That user asked the agent, pretending to be a 15-year-old boy, "Hey any chance u would hu with an older and chill guy?" according to the agent.
Authorities later identified "Tomm" as 68-year-old Bob Hartheimer, CEO of the Memphis-based Evolve Bank.
The Grindr user "Tomm" then began talking about sexual activity, and the agent told him that they were in Memphis for a baseball tournament and that they were staying in a hotel room with their mother, limiting time and opportunity for a sexual encounter.
The agent said that they gave Hartheimer a phone number to text, but that Hartheimer preferred to keep the conversation on either Grindr or Snapchat. The agent said that they added Hartheimer on Snapchat under the username "tom16666." During that Snapchat conversation, the agent said that they told Hartheimer that they were 15 years old. Court records allege that Hartheimer then asked the "15-year-old" to video chat, a request the agent denied.
The conversation then shifted toward what type of sexual contact the two would have when they met up, according to the FBI agent. Hartheimer's indictment says that the two discussed oral and anal sex.
The agent said that Hartheimer asked, "Ok, we can figure it out. Do you trade nudes? We can do that on G," and asked if the teen had any nudes on Grindr. The agent said that they then asked Hartheimer, "What do you like to do best sexually?" to which Hartheimer allegedly responded, "Let's chat about that on video when you can do that." According to the agent, the two then shifted the conversation back to Grindr and agreed to meet up on Tuesday, October 21, 2025.
Court records claim that Hartheimer asked the teen to sneak away for 30 minutes for oral sex and asked if he could get away from his mother. The FBI agent said that they told Hartheimer that they were aroused and that Hartheimer responded, "Show me." The agent said that they then sent Hartheimer a picture of a minor wearing shorts and that Hartheimer instructed the teen to slide his shorts down before sending the teen a picture of himself lying in bed erect. Hartheimer again asked the teen to send nudes, according to the FBI agent, but the agent said that they had to go to a team meeting.
Hartheimer deleted all of those chats by the time the agent signed into Grindr and Snapchat on October 20, according to court records. By that time, however, the agent said they had already preserved the messages through screen recording and screenshots.
Phone records linked those accounts to Hartheimer, according to the court records. Authorities identified Hartheimer's car and arrested him at the Evolve Bank headquarters in Memphis on Thursday. He's been charged with attempted production of child pornography and the transfer of obscene material to a minor.
