In actuality, his crime wasn’t as bad as if he was caught distributing weapons, although an argument can easily be made that distributing masks protects potentially violent rioters from mitigation and crown measure controls, which should still be chargeable. HOWEVER, what I think everyone almost inherantly understands is that this is not some small scale “enabling” that has anything to do with the first amendment. The scale and cost and organization of a maneuver like this is on the level of conspiracy.
No sane or intelligent person believes he was able to afford or organize to procure that amount of disruption enabling resources on such a short notice
