Since 1968, when Congress passed, and President Lyndon Johnson signed into law, the first federal hate crimes statute, the Department of Justice has been enforcing federal hate crimes laws.

It started after the First Democrat-Republican War. Since the original Constitution did not give the Federal Government the power to end slavery the winning side put the necessary amendments into it. Funny thing about giving the Feds extra power: they grow it beyond what was intended originally.
