I would agree with you but drawing a gun is not always a felony in Texas. As a misdemeanor, there is a mandatory minimum jail sentence of 9 months and up to one year in county jail, but by shooting someone dead it leaves that decision up to the courts. And by leaving it up to the courts if you kill someone, even if you suspect a possible life threatening act by the deceased, you might pay a hefty price. This is why since these types of incidents are done close up, you won’t be charged with murder if you drop him with a leg shot. Also, they don’t generally die from that so when they try to pick up the gun, shoot them in the other leg.
