I think the difference is, if she wanted it it’s a child, and if she didn’t it’s a clump of cells. There are some pro-choice people who are nevertheless ok with the existence of criminal murder charges for the willful murder of unborn children, when the mother wanted the child. That would then lead to two counts of first degree murder in this case.

Killing the unborn is only conditional murder - those that are for killing are innocent of murder because they don't believe it is murder.
