ADA Jim Kraus: Simply cannot be reasonable for someone to be holding an AR rifle with powerful ammunition, and be chased by someone who is unarmed, who is smaller, shorter, and the first thing that you do to defend yourself is put four rounds into them.
Kraus: Four feet from muzzle. First shot immobilizes him, causes him to go forward, crumples to the ground immediately. No one is saying that Rosenbaum should have chased him, or that Rittenhouse didn't have right to defend himself. First time ever, focus of state's case is that force used was to prevent imminent death or serious bodily harm.
Kraus: Kyle has size on him, punch him in the face, kick him in the testicles, you don't just get immediately to shoot someone, and I don't care about provocation or any of that.

Kraus: Why do you get to immediately just start shooting. He brough a gun to a fistfight, and too cowardly to use his own fists. He has to start shooting you. Imagine the 12 of you believe reasonable to use deadly force--shoots once, takes out his hip. Could just take one step.
Kraus: He could have held back at 1 shot. GG didn't get four, Huber didn't get four, JKM didn't get four. What threat is someone who have shot in the hip is falling and put the kill shot in the back? Hit him, kick him, knee him.
Kraus: Let's talk about games. Rittenhouse did not tell anyone about this grabbing of the gun, using the gun against me. That is because once Rittenhouse and his team understood that an unarmed person chasing him, and later on would not be enough.
Kraus: Suddenly they had to concoct a story. Why didn't Black know that Lackowski know that Fiedler know that. Here's how Rosenbaum's hand would have been on gun, not grabbing, accidental or defensive.
Kraus: Supposed to believe Rosenbaum is Jason Bourne who could kill with his bare hands and deserved treatment he got from defendant.
Kraus: Richards close was personal, personal against Binger. And he talks about Ziminski's he knows they are charged by my office and have a 5th Amendnment right--

Kraus: They just spent two hours talking about how bad Kiminski is, and now they want us to give him immunity?
Judge: That's not what he said.
Binger: There was a witness not available at last trial date, needed more time to get him in, not delaying to suit this trial.
Judge: Well, not in evidence.
Kraus: I asked DeBruin about pending case against Ziminski.
Kraus: I mentioned on cross of DeBruin that he would be witness in Ziminski case.
Binger: It is in evidence that Ziminski has prosecution coming. I even mentioned it in my close.
Judge: You're making it sound as if Ziminski is unavailable because of testimonial privilge, Richards is asking for sur-rebuttal because somewhat under the control of district attorney.
Judge: I will ask you to move on.
Kraus: My next line of argument was going to be that they could have called them.
Judge: No they can't.
Kraus: They could have Kelly, got her from jail.
Richards: We're not obligated to call ANYBODY as a witness.
Kraus: Neither am I.
Richards: YOU have the burden of proof.
Richards and Kraus sniping at each other.
Judge: Direct comments to me, please. I'll just tell jury that Mrs. Ziminsky could have been called by either party.
Kraus: Richards talked about how Binger was calling everyone a liar, never did that except Rittenhouse. Richards said we never brought up provocation at open. He knows that's a legal thing that we mention and end of the trial.
Well, no, not to general concept.
Kraus: Never hear the threat on video. They can't agree on when it took place, can't agree on where it took place, only few seconds of whole night not on tape. A concoction.
AFB: Kyle purported pointing gun all night also not on video.
Kraus: Defense admitted exhibit #41 where it says Rittenhouse pointing gun at Ziminski's, question mark.
AFB: Well, that's not a statement of fact. That's a issue of inquiry.
Kraus: Rebuttal put in two very blurry pictures. Binger didn't even use them in closing. Defense is seizing on them, inaccurately says 20 hours to do. He workd on drone video for 20 hours, made shorter images, photo is last part of that, but shows holding gun.
Kraus: Defense doesn't like pictures because shows client lied on the stand, and shows provocation.

AFB: Well, Kyle didn't have elevated drone view.
Kraus: Exhibit 10, Ford Fischer, after shooting, pushing wheelchair away from Car Source #3. Claiming Jump Kick Man pushing wheelchair?
Not sure why Kraus is being allowed to claim that Jump Kick Man attacked Kyle at scene #2 because he saw Kyle shoot Rosenbaum at scene #1--there's no testimony from Jump Kick Man about what he saw, never identified or testified.
Kraus: Pointing of gun not an issue at trial until the defendant lied about it. More drone video, Rosenbaum does jump, slowing down, preparing to shoot, look at where first shot is. He's not reaching, shot in hip and falling, shoots him in the back.
Kraus: Face down falling to ground when hip shattered, shot in back, killed that way, when he was helpless.
Kraus: RIchards said Smith called defendant, Smith never testified that, we don't know who called defendant to scene. And despite mad men out there, threatened to kill defendant, defendant goes out there by himself anyway.
Kraus: Rittenhouse said he didn't hear the F-you, didn't factor in the gunshot.
Kraus: Richards says how Howard testified a certain way, didn't talk about the drone footage, knows we got the drone footage surprisingly after Howard testified.
Kraus: Guns are not handed, there's not a right or left handed gun.
AFB: Stag Arms sells right- and left-handed AR rifles.
Kraus: Demonstration that Binger did is how it happened, Defendant was facing that way, picked it up, Det. Antaramian saw it and testified to it, wasn't an issue until Rittenhouse lied
Kraus: Video doesn't lie, but Rittenhouse does.
Kraus: Sorry we followed Marsy Law as we understood it. GG followed advice of counsel. We have his whole video of that night, what more do we need? They just want to dig up dirt.
Kraus: Defense just wants you to believe that these are bad people doing bad things and they got what was coming to them, and we should thank Rittenhouse for killing these people.
Kraus: Rush to judgment? Rittenhouse turned himself in. Are you supposed to wait weeks to charge people we know murdered people? It's a red herring, and attacks on those Rittenhouse killed, not in imminent fear of death or great bodily harm.
Kraus: Heard from Swart, not dispute he came from hospital, Swart said she talked with hospital, she knew he was coming home from hospital. Medical papers in there. <
Kraus: Swart said he was given medication that day, perhaps bad result, bad reaction, I don't know, not a doctor, could not get meds for future days. p> Kraus: Took nice photos, wanted world to know about that, more relevant to Ziminski, must have some problem with police and DA offices. He goes to detectives, doesn't give a full story. He was so nervous, door to police station unrepaired.
Kraus: He meets with us in a short congenial meeting, now says it was us trying to change his statement. We show him pictures, videos, is that Josh Ziminsky, is that the same person, yes. That's not change.
Kraus: Rittenhouse denied pointing gun at yellowpants, Richards just admitted he did point the gun, so which is it. We know Rittenhouse trying to be a paramedic, policeman, and fireman, without being trained to do any of those jobs.
Kraus: He is a chaos tourist, trying to be a big deal, and the moment that chaos comes back on him, a little out of hand, and he just shoots him. That is not privileged, that is not reasonable.
Kraus: We know as Gaige has hands up, defendant turns over gun, looks at it, looked at it, reasonable Grosskreutz could think re-racking and getting ready to fire. Doesn't need to be a shell on the ground.
Kraus: Grosskreutz doesn't step back and take a firing position and shoot, he doesn't shoot him earlier when Rittenhouse was being an active shooter, had just shot another person, every right to shoot Rittenhouse then.
Kraus: GG thought Kyle wasn't accepting his surrender. Supposed to be so scared of Glock when defendant was holding an AR-15. Kraus: We hear about kick spinning Kyle 180 degrees, that is Kyle tracking him with the gun. And now a skateboard is a deadly weapon, somebody should tell all the parents giving them as presentes. I guess they should give them an AR-15 instead.
Kraus: When defense concocted grab my gun story, left out that it was attached to him.
Kraus: Imminent threat, not in five minutes I might end up beat up.
Kraus: As people approaching at end, asking why did you shoot him, why did you shoot him. People provoked because they saw him shoot Rosenbaum, or heard shots, or heard others describe. They did it, brave, not deserve to be killed.
Kraus: Kyle has such strong ties to Kenosha, but needs GPS to find Car Source. Doesn't know he can walk one block around police line.
Kraus: These minor issues, Richards mis-stated law, it is not could cause, not likely to cause. It's imminent threat.
AFB: This is a blanket misstatement of the law by Kraus. Everybody takes a beating sometimes, maybe you do get hurt a little bit, doesn't mean get to shoot.
Kraus: Kyle sees this and he runs onto the scene, puts down fire extinguisher, raises gun, Rosenbaum yells gun gun gun, very likely while yelling friendly friendly friendly he's pointing rifle at Ziminski.
Kraus: He raises the gun, provokes the attack, he has to exhaust all remedies before he regains the right to use even any self-defense, much less deadly force. He does not, could have run different way,
Kraus: I don't think we need provocation, an unarmed man chasing you and you shoot him, in the back, because you don't want to fight him? If you are shooting AR at anybody, you have no regard for life.
Kraus: Reasonable doubt, based upon reason and common sense. For which a reason can be given. A reasonable doubt is not one based on mere guesswork or speculation. Defense is asking you to guess what Rosenbaum were doing, Huber, JKM.
Kraus: A doubt arising from sympathy or a fear of convicting, is not a reasonable doubt. Whole defense is trying to show Kyle as sympathetic and everyone else to be a bad person.
Kraus: Those bad people could have been prosecuted. Not executed.
Kraus: You decide what is guilty or not guilty from the menu of options you have. Only imminent threat was Rittenhouse. He's guilty.

Final instructions to the jury about their duty as jurors.
WI jury plays no role in sentencing, that's entirely up to Judge Schroeder.
Some states DO have jury play a role in sentencing.

FLASH: The Wyoming Republican Party voted on Saturday to no longer recognize Rep. Liz Cheney (R-Wyo.) as a member of their party.
I truly think that once Infrastructure got passed, the blue dogs in the Senate would make this spending bill was DOA. I suspect they will do small bills looking at specific items.

Well, that’s good news!
I had been having heart problems, irregular heartbeat. This was decades ago. I didn’t have insurance , but my doctor was on the hospital board. Anyway, it was a Thanksgiving eve, I was in bed, and my heart kept stopping. My husband took me to the ER, I told them everything, that I had run out of medicine and who my doctor was.
They charged me for a drug test. Even though I told them I hadn’t had any cocaine, and my background. They charged e for a pregnancy test eve though there there was no chance.
They told mm e that people lie about drugs. I told them I’m not paying for people that lie, and they never even asked if I could be pregnant.
Anyway, I had to threaten an interview with local news and then they dropped the charges. My doctor helped too.
I feel for you. I hate moving with a passion, although it’s nice once you get settled in 🙂

The same happened to me. I had ovarian torsion. I was in pain, high fever, and vomiting. They first did drug tests and pregnancy. Despite my doctor calling the hospital that she may have appendicitis, and she is clean. (not sure what clean means). At that time in ER, the majority of Drug-related patients were getting help. That day I realized how serious is a drug problem is in the Palo Alto area. I went to Stanford Hospital, Palo Alto.

Unless the jury has been intimidated and is afraid Kyle should be acquitted.
The prosecution did a lousy job.
But prayers will help.
I feel so bad that he was put through this, and his poor mom, my heart goes out to her.
I hope he sues all of their lying, malicious backsides off. I hope Kyle and his family are flush with cash after this....it’s the least that can happen.
