You're right - that's a pretty simplistic take.
But is the actor Baldwin also responsible for verifying a live round isn’t in the chamber in addition to memorizing his lines and acting? If so, then what’s the purpose of a movie “crew?" Why not just let the actors do everything on the set?
You don’t have the ability to convict him.
On the other hand, the gun didn’t kill the woman.
Coincidentally, my family member was shooting a western movie near there and said it’s the norm to show the other actors the weapon is definitely unloaded prior to filming the scene out of safety and as a professional courtesy.
Would he have checked the gun if it was a scene that required him to shoot himself in the head? Or one of his children? Can you think of any other situation in life in which the guy who pulls the trigger is not charged? For example a friend hands me a gun and says it’s not loaded. I point at him and shoot it, and it is loaded? He dies, I’m charged plain and simple.

Does every actor check guns for live rounds? I don’t know the answer but I’m guessing I’ve worked on about as movie sets as you have.

Real guns can be props. It’s simply short for “ property.”That’s why they have protocols to assure that no one is shot.
