George Washington University Law School Professor Jonathon Turley has posited that recent unanimous Supreme Court rulings may be the court sending a message to politicians. Facing threats to pack the Supreme Court and calls for Justice Stephen Breyer to resign, Turley believes the court is making a rare show of unity. Apparently, the logic is that if they show that they’re not ideological (I know, don’t laugh), the Democrats will understand that packing the court won’t make any difference. They’re trying to validate Chief Justice John Robert’s claim that there are no “Obama judges” or “Trump judges.”
There’s just one problem -- the Supreme Court is both political and ideological, and everyone knows it. Trying to gaslight everyone now is asking us to ignore 50 years of bad behavior. Good luck with that.
The reality is that the court is in trouble. It is no longer trusted to be unbiased. The justices are belatedly learning that a referee who isn’t faithful to the rules also lacks the authority to control the game -- as that authority is granted by the players. The justices find themselves in a predicament that was created by themselves and their predecessors.
Literal interpretation of the Constitution would have been easy and noncontroversial. It’s the philosophy that originalist justices subscribe to. Had we stayed out of the world of penumbras and emanations, most rulings would have been unanimous. After all, the document says what it says.
The court’s case load would be substantially lighter. Everybody can read the Constitution and would know in advance how the court would be likely to rule on any given subject. Their rulings would be predictable, and hence noncontroversial. It wouldn’t matter if a justice’s leanings are conservative or liberal. The Constitution says what it says.

There goes that suddenly popular term again: Gaslighting. Yes. I know what it means, but it seems like a cumbersome somewhat tedious method of illustrating a point. But then, who’s asking me?

They kicked the can on the most important case ever. They could have looked at the evidence. Maybe they will show the unity this time and straighten it out when it comes time. And the time will come before bidens term is up. Hopefully. Or they look election year and agree Trump should have been president and deem he won and even though he didn’t serve it. It will go on record he won therefore he can not run again. Lol.

Even if somehow we manage to restore our republic, what do we do about a compromised Supreme Court and justices that are tenured for life?
My bet is most won’t quit.
What do we do then?
Our nation is ruled by men, not law.
The Constitution is the foundational document that sets the rules and boundaries for our governments (federal, state and local)
But those boundaries have been destroyed by the courts that refused to enforce them due to agendas.
So, now we are playing a game of monopoly without rules. Instead of landing on Go To Jail and going to jail, we have loopholes for getting out of jail based on what the banker “feels” is the right thing to do.

Odd how Bush Gore got to the front of the line in 2000, but they refused President Trump’s case.
I wish the Constitution had an Amendment which mandated that the Supreme Court quote directly from the Constitution to explicitly show that every decision was within the scope of a federal court and also that the decision was in keeping with the intent of the Constitution. We wouldn’t have abortion, we wouldn’t have gun control — we wouldn’t have a lot of things.
Further, I’d like the President and also Congress to have veto power over the Supreme Court — if the US Supreme Court quotes the Second Amendment and then says THEREFORE AR-15s are illegal, the President should be able to say “Not so fast! That makes no sense!” and veto that decision. With any two branches in opposition as to the constitutionality of a decision, the third branch should be able to step in and say “I side with this or that”.
My overall feeling is that the federal courts are the hardest part of government to properly handle. And I think we failed. Looking at the Supreme Court’s history, I think it has done very poorly. The Constitution failed. The Court is too political and it has used power inappropriately and there has been no mechanism to stop it.
My little proposed solution above may not be good. But we need to reinvent the Court. The Constitution, as written, got us into this mess. It needs some kind of fix.

There is no such thing as the “Rule Of Law” in a nation of dishonorable, weak men.

Yours is a good idea, an attempt to address the absence of check/balances on the Supreme Court. The constitutional balance was supposed to be impeachment. I think routine impeachment for bad rulings would work. In other words impeach judges as easily and routinely as Dimwitcrats impeach DTrump every one whose opinion or ruling exceeds the constitution.
Time to rethink the meaning of the term: "Hangin' Judge".
