What the Supreme Court’s rulings mean for the 2020 Census and Trump’s attempt to exclude the undocumented from the count

The Supreme Court has cleared a path for the Trump administration to exclude undocumented immigrants from representation, potentially altering the balance of power in Congress for the next 10 years.

The court Tuesday cut short the census count by two weeks, which census experts and civil rights advocates say risks producing a less accurate count. Then on Friday, the court said it would review President Trump’s efforts to omit unauthorized immigrants when apportioning congressional seats. That decision overturned a lower court’s order that had blocked the Commerce Department and Census Bureau from including information about the undocumented when they deliver state population counts to the White House after the census is completed. The justices said they will hold a hearing Nov. 30.

The government has said it ended the count early to provide state population totals to Trump by the statutory deadline of Dec. 31, even though it had originally asked for a four-month extension because of the coronavirus pandemic.

Moving up the end date set off a wave of litigation from civil rights advocates who argued that it would cause an undercount of traditionally hard-to-count populations such as minorities, immigrants and low-income people, depriving them of services such as schools, roads, fire stations and hospitals, along with political representation. Businesses and analysts also rely on census data when deciding where to open new locations or make policy recommendations based on population numbers.

The purpose for the rush appears to be political. Meeting the Dec. 31 deadline helps ensure that regardless of November’s election outcome, the president will have an opportunity to fulfill a July memorandum in which he said he wanted to omit the undocumented from apportionment.

They are not citizens. They are not supposed to be here. They do not get representation. What is so hard about that?

‘Rat politicians trying to steal power by having their states overrepresented in Congress through inflated population counts. It’s ridiculous.

The SCOTUS did not cut the census count short by two weeks. They stayed a lower Court ruling that illegally extended the census count by two weeks. The ruling was 7-1, and you will struggle to find the actual vote count in any news story.

Unauthorized immigrants? Yet another wording style to avoid saying illegal aliens?

Yes, we all understand they are not citizens - however, the Constitution says to include all people in the census and says nothing as to whether illegals should or should not be included in the apportionment. Since illegals have always been included in the apportionment, my guess is the SC will not change it. But we will see.

“The Supreme Court has cleared a path for the Trump administration to exclude undocumented immigrants from representation, potentially altering the balance of power in Congress for the next 10 years.”

So, they’re ‘projecting’ to us that it will take 10 years for the Socialist Democrats to find another way to allow people who should NOT be voting, to vote?

Got it! Stay vigilant, FReepers!

It means ONLY AMERICAN CITIZENS are to be counted to determine REPRESENTATION in the U.S. Congress.

You completely misunderstand. This has to do with the House apportionment and not voting.

Undocumented aliens are criminals. Call them what they are. Enough if these sanitized / Orwellian euphemisms. Comment:, many of them may be just fine to admit into USA legally but the rest include Islamic terrorists and Mexican drug gangsters etc. dangerous

They DO have documents, not legal documents to be here.

Yes, I understand how the census and apportionment works.

I’m just saying the Socialist Democrats WILL find another way to CHEAT if ‘We The People’ allow it.

You can’t tell me that people who are here illegally and counted on the Census aren’t voting illegally, as well. The ‘Rats don’t pass up a chance; it’s a ‘Two-Fer’ for them.

Do you think that the Founding Fathers ever imagined that people would be sneaking into the USA EN MASSE? Perhaps we need an Amendment to clear this up. And no, I don not believe that the phrase means that those who entered illegally should have representation, They can go back to their own countries if they want representation.

I suppose this means all visitors also count for representation. After all, they are shown on old census records wo citizen indication.

Seems ridiculous that slaves could be counted partially, but anyone who did not actually live here would be counted fully.

Perhaps this is one of the few things the Founders really dropped the ball on.

Do you include foreign tourists who happen to be visiting Disney World during the census? If not, why not? Most illegal aliens are migrant workers, here temporarily to earn money to send home. At least the tourists are legally present.

They are Illegal Invaders, not Undocumented Aliens or Illegal Immigrants.

Immigrants are Invited, Invaders are Repelled.
