McCabe knows that discovery would put him on the witness stand under oath, which would be used in the new DOJ case against him.

In a civil case, McCabe can be forced to sit for a deposition. If he invokes the 5th Amendment to the questions, that invocation can be used as evidence in the civil case. If he answers questions in the deposition, those answers can be used against him if he is indicted criminally. This suggests McCabe is concerned he will be indicted. It is also good advice from his criminal lawyer, assuming he has one.
