Agree wholeheartedly. I dare anybody to move to China or Sweden and say their kids are citizens.

Unfortunately, the Court, in Kim Wong Ark did not take Sen. Howard’s postscript into account.

It could be the parents were here legally. - Tom

Changing this will require an act of Congress. It shouldn’t, but it will.

Kim Wong Ark’s parents were Chinese citizens, but here legally.

However, taking Sen. Howard’s post script literally, no one born to a foreign national in the United States would be granted citizenship.

And that view had never been the case.

For years on FR there were FReepers that argued FOR the current take on this.

If the left believed in the Constitution we wouldn’t have a problem so citing something they fail to recognize is irrelevant.

People in the USA on a visitor visa are here legally. I do not think that children born here while they are here on a vacation should be citizens. There are already birthing centers in California where pregnant Chinese women are coming, having a baby, then taking the US citizen baby back to China for return to the USA at the time of their choosing.

I do think that children of people holding a green card as a permanent resident should be citizens.

When the 14th was written and ratified, there was no such thing as an illegal immigrant. The common law was that every non-slave baby born in the US, including its territories, was automatically a citizen.

The 14th extended that understanding to former slaves and babies of former slaves.

Under the jurisdiction clearly referred to those with diplomatic immunity. Do you really want to give diplomatic immunity to 12 million illegals. Think about the repercussions before you dig too big a hole for yourself.

You win.

The Left is determined to destroy America.

Deport all Illegals …… Immediately, especially the Anchor babies and their families, ….. they were illegal when they entered our Country. Having a baby here from the illegal mother ……. makes the baby and instant illegal from it’s first breath.

Deport all illegals. End of Story.

In Inglis v. Trustees (1830) and Elk v. Wilkins (1884), the Supreme Court ruled that a child born on U.S. soil, of a father who owes allegiance to a sovereignty other than the United States, is not a U.S. citizen at birth; the citizenship of such a child is that of its father, not its place of birth [20]. Consequently, the U.S.-born child of a foreign-citizen father cannot be a natural born

Unfortunately, the Court, in Kim Wong Ark did not take Sen. Howard’s postscript into account.

So we have constantly been told, but this isn't accurate. The Court emphasized heavily on residency as being a necessity in acquiring citizenship.

Besides that, the Chief Author John Bingham made the point much more clearly. You can read what he said in the tagline I have been using for the last 8 years or so.

And that view had never been the case.

Not true. It was the case quite a lot. Indians, for example, didn't even get citizenship until the Indian Citizenship act of 1924.

Barr remarked that he didn’t have enough information to take a position.

What an artful dodge. The issue just isn't that difficult nor is Barr so inexperienced as to mistake the left's agenda. There was nothing at all to be gained in that setting by openly declaring hostility toward one of the left's strongly cherished myths.

My argument for some time has been that Trump need only issue a correction to the current interpretation of "anchor babies" (one solidly prepared by his legal people) and then let others take it to the USSC, who may or may not hear the issue.

No amendment, no legislation, just a letter. Such would be very timely and cost-effective.

OTOH, I was a bit disappointed with Barr 's absolute declaration there was no basis to fire Mueller. A transcript may show language that would not preempt firing him, but the nature of the appointment on the face of it is reported to have been improper.
