So, the Senate could just go ahead and hold the vote, no FBI queered investigation needed, as long as they are assured they can replace Flakes vote with someone else? And use Pence as the tie breaker, should it come to that? Absolutely.
I expect McConnell will suss out Collins and Murkowski. He can afford to lose Flake's vote, but no more. If either one or both of those derps demand an FBI investigation, then BAM, there will have to be one. If not, then not.
That is my assessment. Oh yea, put Manchin on that list too.
Let's see what these so-called Rs are made of.

FBI will not launch criminal investigation into Kavanaugh allegations: sourcesAccording to the Justice Department, on Sept. 12, the FBI received a letter dated from July 2018, obtained by Sen. Dianne Feinstein, D-Calif., alleging that Kavanaugh engaged in an incident of misconduct in the 1980s.
The FBI forwarded this letter to the White House Counsels Office, the spokesperson said. The allegation does not involve any potential federal crime. The FBIs role in such matters is to provide information for the use of the decision makers.
An FBI spokesperson, earlier this week, said in a statement that Fords Sept. 12 letter was included as part of Judge Kavanaughs background file, as per the standard process.
All Mitch has to do is say..."The FBI has already made a decision on the matter" and take the vote to the floor.

I thought about that. If Wray could send 5 FBI agents TODAY to interview each alleged witness, and send interview reports to Judiciary tomorrow, it would be over. They would not say who is telling the truth, just what each person said. The next thing that would happen is that Dems would start dissecting the reports, saying they need to examine the witnesses, need to follow up on something. And we’d need another delay.
McConnell needs to call the vote and let the 3 days go so they can end debate and have the vote early next week. That’s the only thing that will ever end this. And when the vote comes, someone will need to tell the waverers to get their S together or there will be hell to pay. If Trump can get an FBI report done during the 3 days, great, but the clock needs to start ticking NOW.
