Looking for attorney.
6-21-2018 | Myself

Posted on 06/21/2018 6:33:41 PM PDT by TermLimits4All

I'm hoping someone may have a way of finding an attorney that I can hire to sue my HOA and management company for damages.

I have more than one family that will be seeking damages for non enforcement of the covenants in our subdivision.

I have been trying to sell my home and have received feedback from multiple buyers about conditions in the development that I had previously reported. The board decided to waive fines on one particular party that had 108 violations. New board members are friends with this family.

Secondly they are not responding to additional submittal. The management company said we have to take it up with the board. Why are we paying the management company then? Finally the board members decided to take over a neighbors Facebook page, even removing her as an administrator, deleting any of the neighborhoods supposed negative comments. They are now stifling free speech on this neighborhood site.

Thanks in advance for any helpful info. All I can find online are the lawyers.com sites and they try to get you into a monthly pool system. Not sure these are legitimate.

I would add a contested divorce against a borderline personality, vindictive, delusional female spouse with minor children involved to your list of horribles.

OMG,you got that right!

Contact your local bar. They can make a recommendation

My posts were of the “avoid litigation at all costs and prepare to take a loss if necessary” variety. Useful I guess, but not in terms of actually offering advice on how the actual problem might be addressed.

Your post, OTOH, provided some hope in that direction.

HOAs are worthless. My wife and a few friendly neighbors ran for the board here locally. At the first meeting of the newly elected board they set fees at 0$ and scheduled the next meeting for 2048.

People take turns mowing the commons areas. Some go around and take donations for various projects. It has worked out very well. Property values have skyrocketed. You would be surprised by how many people hate HOAs. Bunch of nibby nellie want to be bureaucrats.

My best friend is a real estate attorney and represents numerous HOAs. Take my advice which she just have to a homeowner recently. Sell your house and move. Fighting HOAs is a no win. And she does not love HOAs.

You bought property that had an HOA?

You don’t need an attorney... think Mental Health ... pick any field as they are your only hope.

The best advice so far....

Thanks for the advise. We have just purchased a 4 acre track of land in the same general area that we currently live. Has a 30 year old house on it that we will live in while building our new home. I think I’ll rent out the home we currently have.

Long story short, I’ve taken the advise of the majority of the comments on this thread and God found us the perfect opportunity at the perfect time.

The grease thing will get the city/county very involved - report it to code enforcement. Images are best but date, times and specifics are good also.

Try the Yellow Pages, Attorneys is the largest section in the book and easily outnumbers plumbers........

Smart move. I was 30 years in the mortgage industry. You could not pay me to live in a SD with an HOA.
