VANITY, eh? - Question about historical precedent and NBC (NOT the Commie TV network)

Winston Churchill was English. He was English because he was born there to an English father, just as being born in say, Canada, to a Canadian parent, mother or father, would make one Canadian. Winston Churchill's mother was American, right? And after the war, because of his leadership, he was the first person granted by Congress the title of "Honorary American Citizen", or something to that effect. Right?

Why was that necessary? Why wasn't Winston Churchill already considered a Natural Born Citizen of the US? His mom was American, wasn't she?

Instead of being granted Honorary Citizenship, why wasn't he just awarded the Medal of Freedom or whatever, and a big party thrown for him and all kinds of other cool stuff?

Why didn't Winston Churchill relocate to America after the Labor party threw him out of office in 1945, and run for President here? He was a cool guy, right? He would have been a NBC at the time, wouldn't he?

He could've kicked Harry Truman's butt in 1948.

His mom was an American, wasn't she?

Well?

if Ted Cruz was a natural born American citizen so was Winston Churchill.....

and was equally eligible to be president of the United States...

Apparently. Suits have been filed in blue state after blue state to keep him off the ballots. In all cases Cruz has been declared eligible.

Prior to 1934, U.S. citizen mothers could not transmit U.S. citizenship to children born abroad; only U.S. citizen fathers could do that. In 1994, Congress passed the Immigration and Nationality Technical Corrections Act, which added INA 301(h) (8 USC 1401(h)) which granted citizenship to people born abroad to a U.S. citizen mother before 1934:

The following shall be nationals and citizens of the United States at birth:

(h) a person born before noon (Eastern Standard Time) May 24, 1934, outside the limits and jurisdiction of the United States of an alien father and a mother who is a citizen of the United States who, prior to the birth of such person, had resided in the United States.
This section was specified to apply retroactively to the date of the person’s birth.

There are residency rules for the American mother that affects the citizenship status of the child. It is not simply a matter of the mother being American, but where she has been a resident and for how what length of time prior to giving birth.

Quite a lot. For one, Churchill was born in 1874. The first law granting citizenship descended from the mother was the Cable act of 1924.

Prior to that, only the Male could pass on citizenship.

Secondly, an act of congress granting citizenship to people is just a form of naturalization, so even if Churchill had been born after 1924, he still wouldn't be a "natural" citizen, he would be a naturalized citizen.

Churchill was certainly English. But he played down his American mother because it would have been bad politics to put her in the limelight. The British were allied with the Americans in the war, but felt some resentment at the idea of giving them too much credit for winning it. If Churchill led the way to victory, then he had to be fully British.

As for Cruz, he is turning out to be—and evidently always was—a natural born crook.

NBC means what "principled conservatives" want it to mean at the moment, not what the Constitution and legal precedent dictates that it means.

DL, what would stop all the speculation would be for Cruz to unseal his Consular File. While he’s at it, he could unseal his college records as well. If people were allowed to examine the facts, speculation would necessarily cease.

If everything in Cruz’ Consular File is in order, why not show it? The rumors do Cruz no good. Straightforwardness, openness and transparency would not only be a welcome change of pace, but if they concomitantly verified Cruz’ citizenship claims, it would be win-win-win.

OK, anarchy it is, then.

Pointing out the facts in this case does not mean that I approve of every ruling ever made in every case decided by judges, quite the contrary, but here we are.

You hate Cruz, I get it. If I have a single issue it is strict-constructionism. I, therefore, support Cruz. It's only one vote, you two together have already cancelled my vote, so be happy.

Cruzers are arguing that if King George fathered a child with an American woman in Great Britain. The founders have considered that child a natural born citizen of the USA and eligible to serve as POTUS? Totally ridiculous contention, which the anti-American Marxist courts would no doubt uphold.

I don't know anything about his "Consular file." What I do know is that his mother can't give up her citizenship without an "affirmative act" to do so.

Had she committed an "affirmative act" of renouncement, it would be no secret. It would be registered with the State Department somewhere, and I assure you Trump's opposition research would have found it.

Therefore, speculation regarding the citizenship status of Cruz's mother is not only a waste of time, it is deceitful rumor spreading.
