Should. I mean if the mother died in childbirth there wouldn’t be a question. In this case she signed away her rights, she’s done. She is no longer legally the mother.
This should be a fairly easy court case, but sounds like it was legal in Utah.

In point of fact, there are no parental rights, only maternal rights.
Otherwise the law would be sexist, wouldn't it???
