Should anyone walking out of an In-N-Out or Chick-fil-A be arrested for cruelty to cows or chickens? Or is making it yourself a legal distinction? The legal distinction is that it wasn't his rabbit to eat.

If it wasn’t his rabbit to eat, it is a property crime not an animal cruelty crime. Cattle rustlers are not charged with animal cruelty.

He was charged with animal cruelty, not theft.
