I don’t think the way TOU are used now is fair. I have advanced degrees and I’d need hours to fully understand the legal ramification of all the points within. And I am not the majority of people: we know there are some pretty uneducated and barely literate folks around.

I agree. Whether or not it’s an issue in this case, ABB likely avoids any culpability due to their ‘one-click’ hold-harmless.
It’s an issue not properly addressed in the courts, imho.
