Former soldier was sane when rapper was shot dead in Harvey, doctors say

Devin Bonilla, the former Louisiana Army National Guardsman who says his combat experience in Iraq caused a stress disorder, was legally sane when authorities say he killed an aspiring rapper in Harvey a year ago, court-appointed doctors have concluded. Their report, which was filed in court Wednesday, contradicts Bonilla's insanity defense and means a trial jury might be asked to sort out conflicting mental health opinions.

Bonilla, a 25-year-old Harvey resident, is scheduled to stand trial April 6 on a charge of second-degree murder in the Jan. 18, 2014, killing of Bowie Richard, 21. Richard, who used the stage name Yung Kaptin, was fatally shot outside a bar in the 2100 block of Lapalco Boulevard.

Jailed without bond, because prosecutors say he has ties to Honduras and is a flight risk, Bonilla raised the insanity defense in December. That came after a licensed clinical social worker, John Muggivan, and a forensic psychiatrist, Michael Blue, concluded that he suffers from post-traumatic stress disorder. They were hired by the defense to evaluate Bonilla. Their reports have not been released publicly.

With those opinions in hand, Bonilla changed his plea to not guilty and not guilty by reason of insanity. He asserts he cannot be held criminally responsible for Richard's death because of his mental condition caused by his combat experience.

In response to the plea change, Judge Ellen Kovach of the 24th Judicial District Court ordered an independent evaluation by forensic psychologist Rafael Salcedo and forensic psychiatrist Richard Richoux. "They did recommend that he be found legally sane at the time of the offense," Assistant District Attorney Jeff Hufft said in announcing the results.

Bonilla's attorney, John Craft, said he will seek more information in challenging the court-ordered evaluation. "I disagree with a part of what the state's psychiatrists

They use it here because Bowie Richard was largely an exception to what we normally find in “aspiring rappers.” This victim was by all accounts not in a gang, or into drugs or violence. He had a full time job, a wife and two kids. And the Facebook page is downright tame compared to most “rappers”. Finally he is white. In other words when the next thug is described as an aspiring rapper they want you to think of this guy.
