WATCH: What Charges Could Tony Stewart Face?

Will Tony Stewart face prison time for the collision that led to the death of another driver, Kevin Ward, Jr.?

According to Sports Illustrated legal analyst Michael McCann, it is possible.

McCann stopped short of saying that Stewart would face intentional homicide charges, but "he could face something called negligent homicide ... reckless, careless behavior that causes an accidental death."

"Because of the way [he] behaved so recklessly, [he] could be charged with a felony, and that felony carries up to four years in prison," he added.

McCann was clear in the interview that there were no pending criminal charges as of Monday afternoon, and that the discussion was speculation.

He also mentioned that more video and driver testimony could come, which could frame the possible charges that might come against Stewart.

"We don't know if other racers will give public testimony or if there are possible videos that could show more evidence against him," he said.

I saw the video. People who run on to race tracks during races are likely to come to a bad end. Pure Darwin.

im not sure he should face charges. i heard the other driver was pissed b/c of the crash, and got out of his car, on the track while the race was still going on, and started charging running across the track towards the other car and got clipped.

That guy pressed Dawrin for proof and got out in the middle of a freeway.

It could have been anyone who hit him but, he put himself a d others in danger with his reckless behavior.

Sadly he paid for his fit.

Yeah, and PO’d people that run TOWARD the guy that they think wronged them and do it on a race track rarely end up well.

Any DA from Sports Illustrated is almost certain to know nothing about sprint car racing. Time to fill on a boring show.

Stewart was negligent at the least, criminal at the most and Ward was contributorily negligent...both are guilty........

The media is slobbering all over themselves for a sensational story with hopes of forcing changes in something they clearly know nothing about.

I just love the “He’s got a history of incidents” line. LOL I can count those who don’t have a history of incidents on one hand.

yeah but the guy chose to get out of his car pissed and go after another driver on the track while the race is still going on. that’s gotta be primary negligence on his part right there. if he doesnt do that and controls himself, he’d still be alive.

Having seen the video it appears that Stewart sped up and veered into Ward.

In addition Stewart’s history of violently attacking other opponents in the past and even saying he would have liked to run one of them over speaks to his impetousness.

That being said, without the ability to mind read, its impossible to know whether he wanted to hit ward, or wanted to get close to him to scare him, or just wanted to spray him with mud. All of which speak to intent and the seriousness of the crime, should he be charged.

Oh plz.. no way.

The cars are built with roll cages for a reason,, to stay in the vehicle, no matter what happens.

He left the cocoon.. and ran onto a poorly lit track.. even his family sits in wonder of why he did it.

Ridiculous. How about “negligent suicide”?

He was also out pointing at the blue car before Stewart. Should that driver be charged with reckless endangerment? Same range.

None. A racetrack is for driving cars fast and not for immature kids going for a walk and pointing fingers.

BTW NASCAR bores me and other than recognizing Stewart’s name, I don’t know anything about him.
