Which article of the constitution do you feel regulates pornography? The enumerated powers in article 1, section 8 seem to me to be silent on that issue. The fact that you feel that by my pointing that fact out is equivalent to advocating pornography illustrates the hopelessness of the strict-constructionists cause. That is the logic that the liberals use.

pornography is not “speech”

would you let states regulate it?

Could they regulate it like a normal business?

You may only rape minors for your productions between 4 and 6pm?

I would ask what article permits it? The court may have ruled it "Speech" but it most assuredly is not. My understanding of the purpose of the 1rst amendment protection of "freedom of speech" was to prevent the then common practice of retaliation to political speech that was disapproved by the government. (Such as complaints of incompetence or malfeasance.)

LÈSE-MAJESTÉ was a crime in England, but we wanted our people to be able to criticize the government or anyone in it, but it is a strange contention that this notion should empower people to open a sewer and spray the population with the contents thereof.

My take? Any Supreme Court decision post Hoover is automatically tainted by Roosevelt's Lunatic court appointments.
