he decision to bring charges always starts with the prosecutor. Good prosecutors do not bring cases to trial that they cannot win.

Actually that's not so. The best record in American history is that of the United States Postal Inspection Service. They have had a 95% or better conviction rate.

That means somebody somewhere else is losing more than 5% if the Inspectors lose that much.

Part of it is selecting the right law to prosecute under.
