The U.S. Ninth Circuit Court of Appeals upheld a lower court verdict ordering Arizona rancher Roger Barnett to pay damages of $87,000 for holding a group of undocumented immigrants at gunpoint.

As much as I support getting rid of all illegal aliens, I don’t support shooting them on sight...meanwhile, this decision is ridicules and will force others to go to the extreme of taking no prisoners. Kind of message sent, message received.

At this point, wondering if they would have ruled any differently if the illegals had held the rancher at gunpoint!! :(

Probably not!....the rancher would still have to pay!

“The incident occurred in March 2004 when the gun-toting Barnett detained a group of 16 unauthorized immigrants — none of them carrying weapons — on public land near the border town of Douglas, Arizona.”

“He held the group captive with threats that his dog would attack them if anyone moved or tried to escape. Barnett also kicked an woman while she was on the ground.”

It seems the problem was that Barnett detained people at gunpoint and assaulted a lady on public land and was not protecting his own property.

Apparently, the 9th did not was to establish as precedent where any one of us would be subject to be held a gunpoint and kicked by a person who suspected we were committing a crime.

Mr. Barnett will need to come up with that $87,000.

In another story it shows, it caused the victims to suffer emotional distress, saying that a psychologist diagnosed three of the four plaintiffs in the case with post-traumatic stress disorder

It could be that the rancher’s detaining the illegals on PUBLIC land, rather than his own land, was what got him in hot water. (Of course, the people who are supposed to protect the public land from invaders ARE NOT, of course).

If Barnett caught the illegals on his own land, he could make them do handstands at gunpoint, for all I care, until the Border Patrol arrived.
