This clerk is admitting to (I believe) a felony.
Just because he has access to these records does not give him the right to access records with out an authorizing document.
What he claims he has done is no different than an IRS clerk looking up the tax returns of celebrities with out authorization.
But if it is true and he goes to jail for it, I personally would call him a martyr of the first order and deserving of the President's Medal of Freedom (from whom ever would succeed President Biden in 2012).
Except that his statement is carefully worded to avoid saying that HE actually accessed the records. He is saying that his bosses accessed the records and then they told him that there was no birth certificate on file.
Not necessarily. His statement that he was “informed by my boss” that the records didn’t exist suggests a conversation at work.
In other words, he may have been doing a search as part of a legitimate and legal records request, only to find out quite by accident that they don’t exist. He’s no longer in Hawaii, and his knowledge of the matter reaches back to before the state cracked down on queries from the public.
(FWIW, given the rumors, I’d have been tempted to look on my own out of curiousity, and that’s probably what he did.)
