Third, the release of data card information on such a flimsy argument would be chilling. This is private information protected by federal law. There is no reason to release this information to Nifong. He's already shown that he has abused his position of power. Information is power. I'm glad someone reined him in.
I certainly agree with the above and am glad Titus reined him in some. Pehaps I should have said, in and of itself the swipe card data is not a big deal.
Nifong requested the swipe card data for a limited time period, maybe 24 hours, which is part of why I do not see it as that big a deal. Still I know some, maybe many, feel more strongly about this type of information than I do.

Ummm. . . isn't it a little late for him to start investigating this case? Don't you decide who to charge
AFTER you find out who did the crime and get the evidence?

JLS, his stated purpose for getting this information was bogus. "To verify the witness statements". The other lacrosse players will not talk to him. So there is nothing for him to verify. He had his chance to get the information voluntarily and blew it. He will never get it now until the defense attorneys put the witnesses on the stand.
