JLS, the addresses just aren't a big deal and Nifong didn't get what he really wanted.

I agree the addresses are no big deal. I also think the swipe card data is not big deal. Nobody is trying to hide anything from Nifong.

But I hate to say it Nifong did get some of what he wanted, he got to harrass or at least threaten to harrass the families of all team members. Now maybe I am wrong, but the judge's order says home address which I take to be an outside of Durham address, ie parents address.

When this is finally ended and the hoax is up, do the parents have any legal action against AV, DA, etc if they are harassed by their addresses being released? I can not imagine what these parents are going through.

The card information is a very big deal. First of all, the only argument Nifong gave for it was to verify any statements the potential witnesses made. That flimsy argument was not enough to overcome the FERPA protections.

Second, Nifong wanted to go on a fishing expedition with that information. He is not entitled to it under FERPA. No player is obligated to talk to Nifong. I don't think that Nifong knows for certain who attended the party. And maybe he would if he had properly investigated this case rather than turned it into a plotical tool to win the primary.

Loved the line from the defense attorney who said that there wasn't a card swipe at 610 Buchanan! Nifong particularly wants to know where Collin was.

Third, the release of data card information on such a flimsy argument would be chilling. This is private information protected by federal law. There is no reason to release this information to Nifong. He's already shown that he has abused his position of power. Information is power. I'm glad someone reined him in.

I also think the swipe card data is not big deal.

Really? You would want everyone to know what you bought at the campus drug store? when you last went to the campus informary? what dorm you spent the night in last Tuesday? how late you got home July 16? books you took out from the library? where you ate breakfast Wednesday morning?

I am relieved that I gave a false name and address when I got one of those grocery store swipe thingys. If I had given my real name and address I would be destroying it right now.

The swipe card data is a much bigger deal, imo. If Nodong received that info, it would be fodder for him to target certain boys for special harrassment and badgering about what went on that night.

The addresses are easy to get anyway, and the cops should have and could have gotten their permanent (home/parents) address when they went down to DPD for the torso photos.
