It's as if they've followed the case by only watching Nancy Grace, and have noticed nothing out of the ordinary in Nifong's words or actions.

Yep, another idiot Durham judge comes to a hearing without understanding what he was dealing with. I am not sure how much the middle east will preempt all coverage of the case today, but Stephens learned after he was roundly criticized. Titus should be roundly criticized tonight for not slapping Nifong down for to of his comment?

1. The hiding behind the fifth ammendment comment. Even without a jury present prosecutors should not imlying people should not assert their rights.

2. The comment that the players did not cooperate with police.

It makes his comments about rule 3.6 moot if he is going to let Nifong make such points in court and not slap him down.

I seriously thought the judge had fallen asleep at one point. At the end of the hearing, he sounded irritated that he had to actually make a decision. At least he said his decision would likely be on Friday at 9:30 am.

Your point #1 was absolutely spot on. I said from the beginning that Nifong's public statements about the "wall of silence" and its justification for the Non-Testimonial Order was outrageous because it omits the Fifth Amendment in its consideration. In essence, what he did was say (in the affidavit in support of the application for the NTO), "Because you won't confess we don't need any other evidence for an NTO. If you weren't guilty, you wouldn't be silent." (even though they weren't silent, so that, too, was a lie)
