Now there's a question I've been wondering about.
Does he have to keep the case alive, or risk a viable write-in candidate campaign in the general election in the Fall, if the truth of this case finally really gets out to / dawns on the locals?

Even without the general election and the slight chance of a successful write in candidate (that's close to impossible to do), he's so invested that he's got to continue the charade down to the bitter end and demonstrate to his constituency, even if the lax members are not convicted, it's not because he didn't break every rule trying. As long as he continues to do that he will be a hero in the Durham community that elected him in the first place. We're thinking logically and he's counting on the irrational hatred of Duke from a segment of the Durham population.

I can't see where NiFong CAN bow out. I think the next move would be by the Defense to make a motion based on the evidence to have all charges dropped.
Do we know what the calendar says and who the judge will be?? When I see cases moved to a different date on the calendar, I perceive that they are "picking" the Judge. (I Dated an attorney for 10 years)
