Duke Lacrosse DNA: Mystery Man Revealed (Accuser's Boyfriend!!!)

May 13, 2006 — The second round of DNA test results in the Duke University rape investigation show "no conclusive match'' to any lacrosse players, defense attorneys said, but a vaginal swab of the alleged rape victim produced DNA from a "single male source'' — a man not on the lacrosse team who did not attend a March 13 party that was the site of the alleged rape.


Joe Cheshire, a defense attorney for Duke University lacrosse players at the center of a rape investigation, said the latest tests show no conclusive match to any of the lacrosse players' DNA. (ABC News

Defense attorney Joe Chesire declined to identify the mystery man or his connection to the alleged victim, but ABC News' Law and Justice Unit has learned that the unnamed source of the DNA is the alleged victim's "boyfriend," according to her mother.

ABC News is withholding the name of the man because he is apparently not a target of the investigation. Records indicate that Durham, N.C., police gave the "boyfriend'' a cheek swab to collect DNA on May 3, ABC News' Law and Justice Unit has learned exclusively.

It is unclear if or how the first DNA tests missed what appears to be the only foreign genetic material found on the alleged victim's body, defense attorneys said. Two Duke lacrosse players were indicted more than two weeks before the cheek swab was taken from the "boyfriend."

It is also unclear whether the alleged victim had sex with the "boyfriend" the night she claims to have been raped by three Duke lacrosse players. DNA experts tell ABC News that genetic traces of semen can remain in the body up to six days after intercouse.

It's Duke and Durham's future on the line. The only thing the citizens of Durham have done about it so far, is a vote of confidence by electing Nifong.

What they should be doing about it is collecting signatures on a recall petition.

Not IMO. xo not only told us to follow the DNA, but posted an article that said that race can be determined thru DNA. That's when I thought they found semen in her from a black guy, not the white LAX players. I think someone has known that all along....

Yes, in some fictional fanstay short-cutted ideal world. This is a different world, and awful things happen for reasons so that people can become *good* by dealing with them. It's a creation of perfecting, never perfection.

There is a golden opportunity here for both Duke and Durham. But, just like it was Duke what made the first call that night, it's Duke job to lead the dance-a-deux.

Is "tates5a" the one suggesting that the mother introduced the stripper and the boyfriend, or is tates5a the cousin of the accuser?

If so, I find this curious and wondering if THIS might be the boyfriend, also former Durham PD:

A real estate agent and property manager has been accused of bilking clients out of about $22,000 in rental proceeds on low-income rental properties he managed in central Durham. Booker Tate of AT&G Associates is charged with four felony counts of obtaining property by false pretenses, according to the Durham County Sheriff's Office. Detective Sgt. Jeremiah Davis arrested Tate on Feb. 2 after a lengthy investigation. Tate remains out on $10,000 bond until trial, Davis said. Each of the four counts carries a maximum penalty of 10 years in prison. The case is scheduled to go before a Durham County grand jury on Monday, March 21, he said.

The sheriff's department's investigation was prompted by information provided to the district attorney by the N.C. Real Estate Commission, the statewide regulatory agency that revoked Tate's professional license in August 2004. That move was the result of nearly three years of investigation that began after the Independent published an in-depth article about Dunbar Realty, which Tate took over from prominent Durham activist Lavonia Allison and renamed AT&G (www.indyweek.com/durham/2001-11-21/cover.html). After the article appeared in November 2001, Tate's clients began contacting state regulators to report problems with Allison's successor.

Acting on complaints from four clients, Real Estate Commission investigators determined that Tate and his partner Joseph Williams could not account for at least $35,000 and possibly as much as $100,000 in rent money that was paid by tenants but never reached the landlords. A March 2004 audit of the firm's books revealed its trust account--where security deposits and other business funds are supposed to be held--had dwindled to less than $4. The Real Estate Commission revoked Tate's and Williams' licenses last August (Independent Weekly, "State shuts down Durham real estate firm," Sept. 29, 2004, (www.indyweek.com/durham/2004-09-29/news.html).

Client Ann Henderson Brockenborough told state investigators that Tate owed her more than $11,000 in back rent on her family's four-plex on South Roxboro Street, according to commission records.

Sisters Pearl McAllister and Dora Green told investigators they had not been paid at least five months' rent on their properties on Dunstan and Sedgefield streets, a total of about $8,100, and that Tate had failed to transfer about $1,400 in security deposits when they hired a new property manager. A fourth client, Richard Belser, is owed about $2,500, according to Davis.

As the proprietor of AT&G, Tate had managed about 30 apartments and duplexes that rented for as low as $250 a month, according to commission and court records. Tate took over Dunbar's business in April 2000 from Allison, the chairwoman of the Durham Committee on the Affairs of Black People whose family started the company in 1935.

The phone at Tate's former Fayetteville Street office has been disconnected; he could not be reached for comment. Williams, a Durham Police Department employee who resigned from the firm in 2003, was not charged, Davis said.

Durham County court records show the four felony counts filed last month are not Tate's first brush with the law. He also has a history of traffic and misdemeanor criminal charges over the last two decades. Since 1983, he has been charged with 35 offenses, including three counts of writing worthless checks, one count of carrying a concealed weapon and several counts of driving with his license revoked.

Tate's legal problems also spill into civil court, where records show several similar complaints about his business practices where clients have sought court intervention to retrieve their money.

Why would a SANE swab the affected areas if she was told by the AV that the assailants were a condom?

Logically the only DNA that would should would be the boyfriend.

Also, if the other fingernail contain DNA from someone who wasn't identified as an assailant, why introduce it as evidence. This would be more bad news for Nifong. The DNA is going to have to decide whether to suppress the DNA or allow it to show that the witness is not credible.

Wow. She wants to cast 2 votes for some politician. That may explain why she has been so protected by the DA and police department. If we only knew who that politician might be it might explain a lot.

I don't have any idea. But you are right -- who the judge is on this case IS darned important. And the more I dig into what's been going on in Durham, I'm getting a little more "wierded" about so-called "justice" in Durham.
