May 13, 2006 — The second round of DNA test results in the Duke University rape investigation show "no conclusive match'' to any lacrosse players, defense attorneys said, but a vaginal swab of the alleged rape victim produced DNA from a "single male source'' — a man not on the lacrosse team who did not attend a March 13 party that was the site of the alleged rape.


Joe Cheshire, a defense attorney for Duke University lacrosse players at the center of a rape investigation, said the latest tests show no conclusive match to any of the lacrosse players' DNA. (ABC News

Defense attorney Joe Chesire declined to identify the mystery man or his connection to the alleged victim, but ABC News' Law and Justice Unit has learned that the unnamed source of the DNA is the alleged victim's "boyfriend," according to her mother.

ABC News is withholding the name of the man because he is apparently not a target of the investigation. Records indicate that Durham, N.C., police gave the "boyfriend'' a cheek swab to collect DNA on May 3, ABC News' Law and Justice Unit has learned exclusively.

It is unclear if or how the first DNA tests missed what appears to be the only foreign genetic material found on the alleged victim's body, defense attorneys said. Two Duke lacrosse players were indicted more than two weeks before the cheek swab was taken from the "boyfriend."

It is also unclear whether the alleged victim had sex with the "boyfriend" the night she claims to have been raped by three Duke lacrosse players. DNA experts tell ABC News that genetic traces of semen can remain in the body up to six days after intercouse.

"The History Factory" + "Duke" comes up a lot. Apparently interns at Duke.. and the following article (dated June 1, 2005) which no where has the word Duke in it. Snips:

Even IndyMedia is reporting that the township of Durham, police, sherriffs, etc are intimidated by Black Racialist/Activist Lavonia Allison. And that she runs slumships and intimidates and terrorizes any of the tenants who complain. Snips:

The two institutions that have shaped her life--Dunbar Realty and the Durham Committee on the Affairs of Black People--were born in 1935, five years after Allison. She grew up in the black Durham neighborhood of Hayti, amid middle-class professionals who included the early leaders of what was then known as the Durham Committee on Negro Affairs, as well as the founders and leaders of such key institutions as North Carolina Mutual Life Insurance Co. and NCCU.

McKinney drew her biggest applause when she faulted "the corporate media and Uncle Toms" for not truly representing black Americans' plight.

Just went back to the Tawana Brawley case. Seems when it was all over, Sharpton and others were sued for defamation. The guy got a lot of money. I was wondering why these guys weren't on the Durham Court House steps.

Never realized the indictments were sealed by the judge. It was questioned...and he said he could do it under a certain rule or law.

I'll have to go and see if all indictments are normally sealed. I realize the Grand Jury stuff is secret. Notice we haven't heard anything from any of the Grand Jury members. Is that unusual, too??

So, 2 nails were tested and one came back partially matching some of the DNA profile of Mr Mustache and the other nail had DNA partially matching a 4th lacrosse player.
A player apparently never identified or mentioned by the " false accuser ."
This would validate the defense theory that while the nails remained in the garbage for 5 days, they picked up all kinds of DNA from all kinds of people.
Speaking of nails- my wife is in minute 90 of our press on nail experiment. She bought press on nails and has been just going about normal activities for a quiet Saturday evening.
So far, with only light washing of some glasses- 8 nails are loose and one has fallen off completely.
It flew off when she knocked it against a bottle of water in the refrigerator.
If the FA had been in a violent, clawing, choke hold struggle, as demonstrated by Nifong-all the nails should have been either on the bathroom floor or flipped upright, like a car hood.
The glue is just not strong enough to hold them securely for normal activities, let alone a struggle. I'm sure the defense has the photos enlarged and knows all this.
Interestingly- blobs of the glue, a rubber cement like substance, remain on the natural nail.
I would assume that when the FA's nails were tested for DNA, the tester would have noted the remnants of tacky glue on her natural nails.
The directions are telling -they are very fragile.
" Avoid prolonged contact with water."
" Firmly press nails throughout the day ( particularly after washing hands ).
" After bathing, nails may feel loose.Use hair dryer to dry them out."
"Nails are easy to take off after a shower !"

Partial DNA Matches Raise More Questions, Answer Few In Duke Lacrosse Case

DURHAM, N.C. -- Defense attorneys say there's no conclusive link between DNA evidence and members of the Duke lacrosse team after a second round of tests. While they consider the results definitive, what do the tests really show?

The report report on the second round of DNA testing that was released to defense attorneys late Friday by District Attorney Mike Nifong says DNA from multiple members of the Duke lacrosse team was found on a press-on fingernail worn by the accuser -- an exotic dancer who performed at a March 13 team party in Durham -- and discarded in the bathroom. However, defense attorneys said the report only contained partial matches to the players' DNA.




When a DNA test is run, technicians compare different segments on the DNA. A partial match means that parts of the DNA tested are too blurry to make a conclusive match, but the other parts match so perfectly that the person cannot be ruled out.

According to defense attorney Karl Knudsen, who is not connected to the Duke lacrosse case, the report establishes little.

“The actual results were a little bit unclear,” said Knudsen. “There’s DNA, and there’s DNA. If the DNA had been semen identified to a particular player, that would conclusively establish two things. One, that there was sex, and two, that there was a particular player that participated.”

But Knudsen said the DNA could be anything ranging from dandruff to saliva, and that it could be just as compatible with guilt as it is with innocence.

Defense attorneys involved in the case say that the fingernail was found in a trash can, along with cotton swabs, tissue, toilet paper and other items that would carry the DNA of people who used the bathroom.

According to defense attorneys, a key point the report makes is that the accuser had sex with another man who was not a Duke lacrosse player. However, Knudsen said that it could be a little less relevant to the case if the unidentified male is a person known to the accuser, because that might mean that the DNA had been there five to six days prior to the alleged incident.

A grand jury has charged sophomores Reade Seligmann, of Essex Fells, N.J., and Collin Finnerty, of Garden City, N.Y., with rape, kidnapping and sexual assault.

Nifong is expected to use the results from the second round of DNA testing as he brings his case against another Duke lacrosse player before a grand jury on Monday.

That was the biggest bombshell of the presser, IMHO.

Nifong said there were no vaginal swabs.
There was a vaginal swab with identifiable DNA.

And it is the rare talking head who has mentioned it. When I picked up my son, I listened to Kimberly Gargoyle on XM, and I was shocked! Apparently all the pundits have recovered and this is not a big deal.

It begs the question...What the hell is driving Nifong?
