FRESNO, Calif. (KFSN) -- An ICE agent is in custody at a local hospital after police say he was shot after assaulting an elderly man and his daughter at a home in central Fresno.
The incident happened before 3:30 am Friday at a home on Dudley and Broadway.
The Fresno Police Department says a woman found 32-year-old David Gonzalez sleeping on her front lawn.
The woman alerted her 72-year-old father, who then went outside to tell Gonzalez to leave.
Once Gonzalez was woken up, police say he appeared drunk and assaulted the 72-year-old.
Police say the daughter tried to intervene to protect her father, and Gonzalez physically attacked her.
Fearing for their safety, officers say the 72-year-old man pulled out a gun and shot Gonzalez.
The woman's boyfriend, who is a police officer and was off-duty, came to the home and put Gonzalez in handcuffs.
He was taken to the hospital for treatment and is listed in serious condition.

The father was within his rights, but at 3:30 AM that was a dumb thing to do. Call the cops from the safety of your house.

That is an excellent comment. Rather than confront the dumbass, they should have called the FPD and let them contact him.

I too wonder though what he was doing passed out on a lawn in Fresno at 3 am. In the coming days there may be clarifying information, but he is likely to invoke his Miranda and 5th amendment rights and not give a statement.

That was my thought as well. And at 72? A very bad idea.
First rule of deadly use of force. If there was an available alternative to shooting (like avoidance), grandpa might be in a world of sh!t right now. I hope that’s not the case.
Don’t know if you’re making a joke, but one of their city councilman made that statement. It was a freakin drunk guy who just happened to be an ICE agent. What if he was a mechanic, then would he ask for all mechanics to stand down?

Bad idea for the Ice Agent to challenge a weak old man.
They may not be able to whip your ass in a fight, but they sure can shoot you.
