In a way, it is questionable whether Title IX is Constitutional in the first place. There is no Federal power to enforce equal treatment with respect to sex in Article I Section 8. AFIK, the 14th Amendment only applies to Constitutionally enumerated powers. Therefore this would be a State matter.

So it may sound goofy when it comes to outcomes, but this may be where Gorsuch is going.

Usually the way the Feds will enforce the law is by withholding the funds from the state.
