Question about Judge appointed Senate Nominees

My buddie says that there are several states that will not allow the dims to put another candidate on their ballot for President. He says, ITS THE LAW.

Then I tell him the law is for republicans and suckers because the dims simply get a judge to go around the law.

There was an incident I need help remembering. I believe it was a senate election in NJ some years ago, maybe in the 90s. The dim nominee either withdrew or died or something within weeks of the election and the NJ law didn't allow them to put anyone else on ballot THEN they got a judge to let them put up a new nominee who won.

Does anyone remember the details of that. I've looked for it but can't find it.

I think this will be pertinent this election cycle. As a practical, if voting has not started, they will find a way to fix the ballots. It might be handled by a state secretary of state if they have the authority, by the state legislature, or by a court. I think this is only fair and everyone should remember that in the future it could be our candidate needing replacement.

The bigger challenge, bring in the attorneys, is if voting has already started. I don't see how they fairly update the ballot unless they void the votes to date and start over. Maybe that is doable in a state that starts voting in September, but for a presidential election, I think it is a non-starter.

No, he was referred to as “The Mummy.” They got him out of his sarcophagus to run when crooked Robert Torricelli was proven to be corrupt and dropping like a stone in the polls…about 10 days before the election, IIRC.

I was the conductor running the very first “ garden state special”, which lautenburg got Amtrak to add metropark to its station stops.Big fanfare, tv at metro, but no train. We were delayed out of sunnyside, showed up over an hour late! Doah!

Your friend doesn't know what he's talking about. Nobody is "on the ballot" yet. There are places reserved for candidatse of the major parties, and the minor parties that have qualified in the states they have qualified in.

The Parties have to formally nominate the candidates, and then transmit the name of the for formally nominated candidate to the individual States, usually the Secretary of State. The deadlines for all the states I looked at is right around September 3.

Until that happens there is no name to take off the ballot, and all the laws about taking names off the ballot do not apply.

This is really basic stuff, and it's silly that so many people are confused about it, or lying to sell clicks. (Gateway Pundit, I'm looking at you).

Both President Trump and President Biden are merely "presumptive nominees" of their respective parties at this point.

Have you ever watched a national political convention end-to-end? The major business of them is placing names into nomination, (like Niki Haley will be nominated, and maybe a few others) and then having speeches, and then having the big Roll Call Vote where the State that the future Nominee is from usually votes last to put him over the top in the count of delegates needed to be the nominee.

Then there is a big balloon drop. OK, what that Big Balloon Drop MEANS is that the Party has officially selected their nominee.

So, simple rule of thumb: No balloon drop yet, no official nominee!

Biden isn’t being “replaced” on any ballot yet as he is not yet even the nominee. Some have argued that the laws regarding other nominees would apply because the candidate had to have been in the primary to win the nomination, but that’s difficult to see how that would apply, given the winner of any individual states’ primary is not what determines who the nominee is on the ballot in the general election when it comes to the presidency - that is determined by the conventions of the parties and the winner of that is who will appear as the general election nominee in each state...not who won the state’s primary.

As far as others offices, that would vary from state to state.

There was the infamous case in New Jersey back in 2002 where Robert Toricelli was losing so they convinced him to withdraw and replaced him with the more popular Frank Lautenberg. This was against the laws of New Jersey, but their Supreme Court ruled the law could be ignored for the supposed good of the voters...

If Biden withdraws from the race and releases his delegates, then what happened in the primaries earlier this year becomes irrelevant. This is because the delegates no longer have to honor their legal obligations to vote for Biden on the first ballot of the DNC.

My guess is that the “powers that be” in the ‘Rat party are negotiating with Jill as to how much money and other perks (such as an on call private jet) will it take for her to withdraw Joe from the race. The next problem for those who want Michelle Obama, a/k/a “The Mooch” and “The Wookie” is how exactly do they get their mitts on the $240 million war chest that Joe and Jill built up. This is a real problem for them. They may well be stuck with Kamala Harris, whom I’m guessing will royally screw up her convention victory speech.

There are a lot of powerful ‘Rats in the House and Senate, who now know that their seats are in mortal jeopardy. I’m thinking here of people like Marcy Kaptur from Toledo, Ohio, who was in a tough race with a really good conservative termed-out state representative, and now probably can’t get re-elected even under the best of circumstances. Seats like the Michigan US Senate seat being vacated by Debbie Stabenow are real pickup possibilities for us. The ‘Rats know this, and are working 24/7 to put a stop to it.

The Lautenberg/Toricelli case was a NJ state office, and the SCOTUS decided not to intervene. For a Federal election SCOTUS is more likely to intervene.

Yes, I absolutely agree with your analysis. Joe drops out, releases his delegates (which is almost all of them, except the Super Delegates) and we have an open convention.

The jokers at the Gateway Pundit are still peddling the ridiculous hopium that the Heritage Organization is going to sue to preven this.

Come on now guys! You can't sue to make someone stay in a race. That's patently ridiculous. And seeing as the convention hasn't taken place all this B.S. about taking people off the ballot is illegal is State X is just total nonsense.

To repeat my simple rule for the reading challenged:

NO BALLOON DROP NO OFFICIAL NOMINEE YET

"Presumtive Nominee Joe Biden" is soon to be no more.

It's a wonderful series of mishaps to watch and enjoy.
