I don’t believe that it is the document, per se, that DoJ is making use of. This recording shows that Pres Trump knew that he had sensitive documents, that not everything was automatically declassified by his thinking about it, and that he was showing sensitive documents knowing he shouldn’t.
This bit of tape will be used to go to intent and state of mind - what President Trump is saying, not the docs he’s holding.
