Are you saying a US code overrules the US Constitution?
No. The U.S. Constitution does not provide a mechanism to determine which slate of electors should be recognized from a state, if two competing slates are sent. 3 U.S. Code ยง 15 does. Pence as the presiding officer of the joint session of Congress might ignore the U.S. Code with a ruling from the chair, but then that is subject to collateral attack in the courts, if he isn't reversed by both houses of Congress.

Thanks for the heads up for where this might head next, as there is little discussion and media coverage of the various angles and potential outcomes.
As of today, I have not heard of this possibility but will certainly look into it. I would also expect that Pence would side with Trump, as you stated could happen, should your scenario actually come to pass. Thanks again.
