As to the premise of this article, I have no opinion, but I think people have this backwards because they make the false assumption that an election was actually held. I argue it wasn't.

We all know what an election is. It is a covenant between a group of folks to agree to chose someone from time to time, to manage their affairs. It generally has the from that 1.) Candidates present themselves seeking 2.) an office, 3.) at the date and time set, 4.) those entitled to vote, 5.) cast a secret vote 7.) which is collect by the agent assigned to receive and count the vote and 8.)The votes are counted, all of them, equally, with no eligible vote being dismissed and no ineligible vote being counted, and 8.) the tally is presented so that it is evident, 9. according to the rules of voting for that office 10. Who the winner is.

When those steps happen everyone agrees it was an election. Minor irregularities are normal, and are disposed of not just by election officials, but by all the eligible voters to determine if the discrepancy would have affected the outcome. If it wouldn't then all are satisfied a valid election happened, even if they are disappointed with the outcome.

But suppose the rules are substantively breached through fraud or substantial mistake to violate some part of the normal order of business of selecting said representative. At that point the sacred covenant between the electors, the voters, is breached. It ceases to be an election. A contract formed under fraud or mistake is not a contract and can be set aside as if it never existed. Remember, the agreement is between the voters, and each voter has a right to an equal say with other eligible voters in a fair process. The candidate is actually irrelevant. Donald Trump as candidate has less standing in my eyes than does voting citizen in Gorgia Lynn Wood. Official Donald Trump running the whole place where the election took place having substantial knowledge of a jiggered election effecting the rights of the voters is sort of a witness to the contest between voters, which makes him a party, but aggrieved voters are probably essential parties.

So you are looking for a remedy before December 14th for an election that didn't actually happen even though we went through the motions. And I think that is the problem. What is the state of affairs if the constitutional predicate, election day, never happened. The equitable solution is to restore the rule of law and hold a fair election, maintaining the status quo until that happens.

Well from a quick glance at this EO, it seems DNI gets 45 days to look into things to present to the AG, then the AG gets 45 days. IOW sounds like a drawn out process.

So once a decision is reached would likely be after Jan 20 and whoever the president is would make the call on any sanctions.
