Four men set to face trial next month in the fourth Bunkerville Standoff trial have filed a motion asking US District Judge Gloria M. Navarro to dismiss the charges.
Judge Navarro had said that it was alright for the four (Dave Bundy, Mel Bundy, Joe O'Shaughnessy and Jason Woods) to go on trial next month because the hidden evidence she used to dismiss charges for the four defendants in the third trial is now out in the open.
Lawyers for the four men argue that all the events surrounding the first three trials from the conviction of Greg Burleson and Todd Engel in the first trial, the removal of defendant Eric Parker from the witness stand as he testified in his own defense in the second trial and the dismissal of charges with prejudice in the third trial all justify dismissal of the charges.
Last week defendant Dave Bundy filed a motion calling for the prosecutors to be removed from the case because they are potential witnesses in his upcoming trial.
Attorney General Jeff Sessions praised the work of lead prosecutor Steve Myhre, whose political identity is Republican, when Sessions visited Las Vegas last July. He claimed Myhre was "standing for the law" in the case and gave kudos for Myhre's "leadership" in the case.
One wonders why the Justice Department of Attorney General Jeff Sessions and the new interim US Attorney for Nevada appointed by him, Dayle Elieson, have not acted to withdraw the case because of the outrageous conduct of the prosecutors outlined by Judge Navarro in her recent dismissal of charges in the third trial.

What caused you to excerpt your own material instead of posting the whole thing?
It actually is the entire content of the article. The excerpt is a ploy to garner more clicks ? Im guessing here, hard to say with bloggers. I suspect the bloggers are feeding info to their great Google God. Google throws them a few pennies for their efforts.
It was the entire content of the article, but I don’t get any money from Google. Not signed up for the ads.
But I added content to the post to fit the “read more at” mistake I made with my post.
So the click the link for the additional paragraph regarding Cliven Bundy’s public speaking appearance tomorrow in Montana.
Too much trouble to post it here, I suppose.
In your honor, I posted it after I posted the rest of it earlier. Something did need to be added about Mr. Bundy’s speaking appearance.
Cliven Bundy is offering us a way forward from way outside the Beltway to finally resist federal power which is way out of control and shows no signs of stopping.
And what better place to do it than in Interior Secretary Ryan Zinke’s own home state of Montana.
Zinke shunned the Bundy family and their ranch when he visited the area last year to discuss the Bears Ears National Monument proposed by Barack Obama including Cliven Bundy’s 160 acre ranch.
Zinke met with the anti-Bundy environmentalists.
And now Mr. Zinke wants to keep going forward with Obama’s national monuments on a scaled back basis and calls it a victory for President Trump.....NOT
The Bundy family doesn’t even know if Mr. Zinke will exclude their land from the “national monument” designation.
Are against this outrage being exposed?
Asking for the whole piece to be posted hinders exposure HOW exactly?
What’s the matter, Marv old chap?
Can’t answer the question?
Cat got your tongue?
Syphilis acting up?
You have done great service for us. Thank you.
