It’s been that way since at least Wickard v. Filburn — the Supreme Court deciding that should have been hanged by the neck until dead, IMO.
(Being Treason against the several States themselves.)

The marxist attack upon the federal courts began in earnest with FDR. The dictatorship of the federal courts began in earnest with the Warren Court. The senate cannot impeach rouge justices who act as tyrants because a super majority is required to convict them so as to remove them from the bench. The democrats in the senate will not allow this to happen. They will vote en-block to protect the reprehensible marxist judges on the bench. The spineless pubbies could eliminate the offending jurists bench by simple majority vote but they don't have the guts for the fight. We have lost the Republic to federal court dictators. We will not regain the Republic until after the federal courts are fixed. Everything else we read and post about is a distraction from this vital task.
