WATCHDOG: EXECUTIVE-ORDER PLOY 'CRIMINAL CONSPIRACY'

NEW YORK – Following confirmation by the National Archives that President Obama did not sign an executive order to implement the immigration policy he announced to the nation, Washington-based watchdog Judicial Watch has called for an investigation into whether the White House has engaged in a criminal conspiracy to spend taxpayer funds on unauthorized purposes.

“The fact that President Obama did not sign an executive order appears to involve a recognition by the White House that President Obama did not have the authority to make the changes in immigration law outlined in his Nov. 20 speech,” said Tom Fitton, president of Judicial Watch.

Fitton, in an interview with WND, argued executive orders are limited to facilitating the execution of laws, not altering or establishing law.

“Barack Obama did not issue an executive order because he does not have the authority to issue an executive order in this instance,” Fitton said

AS FREEPER KENNYBUNK INSIGHTFULLY (and hilariously) POSTED: The Mombasa MF in the WH was supposed to have signed the "Executive Order" ---- but there is no such thing. "Kid Kenya" pulled a head- fake on the gullible GOPe, that even now is hurriedly stooping to osculate his imperial gluteal regions.

Even Barry Soetoro---erstwhile adjunct instructor in Constitutional law (before leaving the Illinois Bar permanently)----knew that an 'Executive Order' would not hold water. So, he faked it...and set up a Cabinet Secy as the fall guy.

JEH SET UP AS FALL GUY DHS Secy Jeh Johnson, with an IQ of a boulder, is the perfect Affirmative Action Anus fall guy, because he is covered under the 'Melanin Clause," and will never be prosecuted for anything.

Apparently none of the octogenarian ani that form the GOPe old boys club in Congress ... or their uniformly Left Wing staffers ... deigned to notice that ... or what day it is.

The goal, according to several congressional aides familiar with the plans, is to ensure that lawmakers and administration officials are more closely coordinating talking points and media appearances and using all outlets at their disposal to highlight incendiary comments or controversial legislation introduced by Republicans. He wants to provoke impeachment proceedings. That’s the only way to save the democrats and provoke a real revolt.

Just like Holder et al. are trying to ram a federalized police force through by using Ferguson and NY killings as the linch pin, the wreckers are trying to provoke a response. Read the responses to an opinion piece on policing in the WAPO and the trend is to flood the media with calls for a nationalized-style of policing because “all” policing in the US in every community is equally bad.

I can see a lot of court proceedings on the horizon, very soon, as everything he’s doing is pretty much illegal and unconstitutional. The federal judiciary is going to be very busy.

He and his stormtroopers are going to be increasingly lawless as the last of their reign passes.

But Impeach, no. He and his shadow would love to be thrown into that brier patch.

There is one more election this week and Landrieu is consigned to the rubbish bin of history. (Unless the left manages to hijack the voting process.)

Let’s see what a majority GOP does with their power first.
(Or not at all, but I don’t see that happening. No matter how much the media floats the rebellion within the party. Wouldn’t they just?)

They are very busy, dontchaknow.

I have been very busy this week and unable to research much of this issue. Can someone explain to me why he would not sign it? Are there multiple reasons, legal reasons, etc.?

He believes White House counsel concluded Obama lacked the authority to defer prosecutions under the Deferred Action for Childhood Arrivals, DACA, program and decided to implement the policy through a memorandum issued by Department of Homeland Security Secretary Jeh Johnson. The memo was never filed with the Federal Register for a period of public comment, as federal law requires agencies to do when making rules.

If he didn’t actually sign an executive order, then Jeh Johnson, the head of DHS, may face criminal charges for implementing the reported terms of it including unauthorized spending of funds to give green cards to illegals.

On this evening in Vegas in question....he signs two documents. You can view the two over at the national achieves. They are both 3-pagers. One tells the cabinet members to find ways to lessen paperwork on immigration and make immigration easier...then talk about it to the nation (press). The second tells the cabinet to form a national task force to find ‘better’ ways to integrate new immigrants into America.

Neither talk about more immigrants or the lessening of rules unless you take the comment on less paperwork being the focus.

That’s it.

So I come to what I think is the whole angle on this. He had a verbal conversation and asked each cabinet secretary to put out a memo, with his verbal orders being the driving force to the staff memo. Without the executive order, there’s nothing you can do about this in court or have the Supreme Court come back to him and issue an injunction. The Senate would have to bring each cabinet secretary in and ask what verbal instructions were given, then you ask what they’d do. You can’t prosecute or do anything with the President....IF he didn’t sign such an order.

The House could react by just writing a simple bill that none of the following actions....just list what he said on TV...can be accomplished without a law enforcing such events.

I would also add this. If you walked in Harry Reid’s office and discussed this event...Harry is probably shaking his head and just hostile/frustrated with the White House and their angle of accomplishing things. He’s carried their anchor through lots of stupidity for six years. Maybe he might be ready to push six Democratic votes over to the Republicans for massive retaliation on the White House, to correct what has gone wrong.

Bottom line? Nothing was ordered and signed. Therefore, nothing can be prosecuted. It’s what they’d do in Bolivia if they were still a third-world country (they actually moved up to 2nd-world in the last couple of years).

Wow

These is nothing more terrifying to a government employee than the three letters GAO, Government Accountability Office.

They move very slowly, but sift very finely. By the time this gets though the GAO system we will have a new President. This is real jail time folks.

Right now many are asking themselves, Jail time for Obama?

No need for Congress, put the fear of God in those minions who have to carry out the what ever it is the key phase is “conspiracy to misappropriate public funds”.

This involves the Anti-deficiency Act, which prohibits government from creating an obligation to pay money before funds have been authorized.

The penalties for violating that law are spelled out in 31 U.S. Code Section 1350.

The INDEPENDENT GAO will be happy to oblige.
