You are correct. They are being treated the same as US citizens from another state. The issue is whether they should be.

No they are not being treated the same. The state law says something about residency. Federal law says something about residency as well and guess what, illegals and US Politicians don’t give a shit.
An illegal can cross the border today and get in state tuition.

Wrong. We tried to get them out but the Feds won’t deport them.

We try to catch them at the border, but the Feds dont do anything but “catch and release.” We arrest them, the Feds requireour local law enforcement to prosecute, make it harder to check status, and, after conviction, release these criminals. http://www.heritage.org/research/reports/2009/07/section-287g-revisions-tearing-down-state-and-local-immigration-enforcement-one-change-at-a-time
