States Should Block ObamaCare Using The 10th Amendment(States Rights)

Bills blocking Obamacare should be introduced by Republicans in the state legislatures of every U.S. State.

The bills should declare economic sovereignty from Obama's socialist health care program under the 10th Amendment to the U.S. Constitution.

AMENDMENT X

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Every state that passes such a bill should refuse to send health care money to Washington.

It's time to fight Obamacare in all 50 States.

The States rely on the Feds for $$$$$$$$$$$$$$$$$.

No State will do battle with their benefactor.

Heh, why? 100 years of non-constitutional laws passed in this country.

The state legislatures are just as bad as the federal one. Sorry, but I’d !@#$ glass if it actually happened.

IMHO, using the Civil Rights Act and the 14th Amendment arguments would be much more exciting.

This crime committed by Congress is lifelong indentured servitude of the entire population and every business with employees in the country.

A tax is a tax.
A required payment from a private person to a private corporation under threat of home invasoin search warrants, arrest, prosecution, and jail terms is not a tax. That is the definition of indentured servitude as written into law during the years between the Missouri Compromise and the passage of the 14th Amendment.

Don’t forget Bama too. We have all but one conservative congressional district (including the most GOP district in the 6th district at R+29). Plus, the Republicans are going to take the House, Senate, and install a conservative governor (Byrne most likely). It doesn’t matter how many RATs live in the Black Belt, we outnumber them 2:1.

YES, ABSOLUTELY YES!!! It is the only way that we the people, will be able to effectively resist & fight against the socialist atrocity. I really believe that Texas & Oklahoma need to secede & start the ball rolling, followed by 8-10 southern states. I will be the Civil War all over again, only this time there will be sizeable contingents in the northern states who are as equally opposed to the health care takeover as anywhere else in the nation. Yes, the individual mandate needs to be challenged all the way to the supreme court. Such a mandate is essentially the federal government taking OWNERSHIP of the individual citizen, and does create a form of servitude. There is no power under the constitution to do that. Yes, they can raise an army, but that is specifically allowed as a power of the government.

Not a bad idea, but the Supreme Court will probably find some strange way to block states’ rights (ex. Roe v. Wade).

I spent most of the summer working on data for my state rep to get this going. The other night he told me that “the people he spoke with thought it was TOO CONSERVATIVE”.

There you have it folks, a 10th Amendment resolution can be introduced in MA, but it is TOO CONSERVATIVE for Delaware. A 10th Amendment resolution can be introduced in Illinois, but it is TOO CONSERVATIVE for Delaware. My guess is that Mao, Stalin and Fidel must be considered TOO CONSERVATIVE for Delaware.

Two hundred and thirty four years ago, we fought the British over bad government. WE ARE WORSE OFF TODAY THAN THEN. At least, the British were 3000 miles away!

DECLARATION OF NEBRASKA STATE SOVEREIGNTY
BY THE PEOPLE OF NEBRASKA

When in the course of human events, it becomes necessary for a people to rectify the political wrongs of a government, and to reassume among the powers of the earth, the separate and superior station to which the Laws of Nature and of Nature’s God entitle them, a decent respect to the opinions of humankind requires that the People declare the causes which compel them to the resurrection of their God-given Rights, long eschewed by the Government’s leaders, and summarily executed by the Government’s wrongs.

As such, We, the People of Nebraska, hold these truths to be self-evident: that all Men and Women are created equal, equal in opportunity but not result; that the People are endowed by their Creator with certain inalienable Rights; that among these Rights are Life, Liberty, Property, and the Pursuit of Happiness; that to secure these Rights, Governments are constituted of elected and appointed officials, but constrained by the Constitution, which derives its power solely from the Consent of the People; that whenever any Form of Government becomes destructive of these ends, through congressional legislation, executive action, judicial decision, or administrative regulation, it is the Right of the People to not only declare these means a nullity, but also declare the superior Sovereignty of their respective States to better effect and protect these ends.

Therefore, We, the People of Nebraska, do solemnly declare that Nebraska is a Sovereign State, equal among the Several States of the Union, but eminent to the Federal Government thereof, which is limited to the enumerated powers of the Constitution, as expressly provided therein, and as directly recognized thereby, in the Tenth Amendment thereto, such that, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

Because the People of Nebraska have the Right not to suffer the Federal Government’s wrongs, they also have the Right to prevent said wrongs by enacting legislation, either by popular referendum or legislative action, through the superior Sovereignty of the State of Nebraska. In order to serve as a rampart against the Federal Government’s past, present, and promised wrongs, the People of Nebraska call upon the Legislature of the Sovereign State of Nebraska to pass, with due haste, and without delay, the Nebraska State Sovereignty Resolution.

Although only a beginning, this action by the Legislature will sound the bell of Liberty, and notify the Federal Government that, despite its long train of abuses and usurpations, the Sovereignty of the great State of Nebraska, and the Freedom of Her People, are not at an end: they are resurrected; they are reasserted; and they will not be arrogated by the Federal Government any longer.
