“Could we change the balance in the Senate with an action like this before 2010?”

Only if your copy of the US Constitution differs from mine.

The Left tried this with my Congressman in the Michigan 7th years ago. The decision at that point was that the US Constitution does not allow for recall of Congressmen.

You are correct. The Constitution is quite clear.

Each House may determine the rules of its proceedings, punish its members for disorderly behavior, and, with the concurrence of two thirds, expel a member.

Recall isn't an option.

You may be correct, my reading of the Constitution states Impeachment. Is that equal to the term Recall?

I am not arguing the point, am not an attorney. But I do know that Recall proceedings have been brought within states for members of Congress.

Have read that no member of Congress has ever been Recalled.

Respectfully,

TF

Looks like I did not examine this close enough before posting. But it brings another point up.

In NY 23 if Hoffman is actually certified as the winner what will be the outcome. Pelosi has already seated his opponent and he voted in the Healthcare Vote.

Will the Congress remove him if he looses.

Dems have run fast and loose with the Constitution for a long long time.

What Is the History of Recall Elections?

By Joshua Spivak

Mr. Spivak is an attorney in New York, and received a Master’s in History from Brooklyn College. His Master’s thesis explored the history of the recall.

I intend to compare his discussion of this subject to my copy of:

“Notes of debates in the Federal Convention of 1787 reported by James Madison.”

The Notes are referenced in the article.
