Supreme Court To Review Obama’s Citizenship

It looks like the Barack Obama citizenship issue will not die until he is inaugurated. It probably will not end even then.

Now the U.S. Supreme Court will discuss the matter in private because one justice decided it was worthy. Before fingering the member of our highest court, I will give a little background information on the case. If you do not think too hard about it, you can probably guess which Supreme Court Justice is responsible.

Leo Donofrio of New Jersey filed suit against Nina Wells, the New Jersey Secretary of State, claiming that she had not performed her duty to ensure the integrity of the electoral process.

Donofrio originally asked a state court to review the citizenship of Barack Obama, John McCain and Roger Calero. Calero was the Socialist Worker’s Party Presidential candidate. He was born in Venezuela. That is a cut and dry case.

John McCain was born in Panama but on an American military base. Legal scholars believe birth on an American military base qualifies as a “natural-born citizen.”  A “natural-born citizen” is one of the requirements to be President.

For Obama, it is the old born in Kenya story again. Anyone who doubts that Obama was not born in Hawaii, please refer to Politifact and Factcheck investigations. Hawaii does not allow birth records to be publicly viewed. This is why no one can go in and see the certificate. It is not because Obama is hiding them, or they were never there. Anyway, after Donofrio’s case was rejected at the state level, he presented it to Supreme Court Justice David Souter who rejected it. Donofrio then presented it to Supreme Court Justice Clarence Thomas who put it on the court docket for a conference on December 5. If four of the nine justices decide to hear the case, then full oral arguments will be scheduled.

Now it is possible Thomas wants to review Calero’s eligibility as a Presidential candidate. There are plenty of acceptable reasons for this. However, the timing, 10 days before the Electoral College meets, only gives hope and ammunition for those who believe Barack Obama has conspired to create the greatest hoax in world history — that he and his family have been hiding his Kenyan citizenship since he was a few days old so he could run for President.

Gee, thanks, Clarence Thomas.

By the way, for those still questioning Obama’s and McCain’s citizenship qualifications, al-Qaeda did fly planes into the Twin Towers, aliens have not abducted millions of people for medical experiments, and the moon is not made of cheese.

Here's a good "What If"...what if the Supreme Court orders Obama to prove his eligibility and he refuses to do so and just goes about his business and assumes the office? What then? Does someone drag him kicking and screaming from the White House? Who?

Chief Justice Roberts has to swear him in. If there's any constitutional problem, seem it would be his duty to bring it up afore hand.

If is true then there's only two choices. Ignore it and hope that it was just a one time thing and that it never gets out that he wasn't qualified...or disqualify him and watch a really ugly mess unfold.

Either way it's not going to be pretty, but the 2nd choice will go away eventually and the constitution will be upheld.

What better way to protect the office of the Executive from foreign influence then to require the President to have inherited his American citizenship through his American father and not through a foreign father. Any child can be born anywhere in the country and removed by their father to be raised under foreign influences in another country. The risks would be for the child the return in later life to reside in this country bringing with him foreign influences and intrigues.

Therefore, we can say with confidence that a natural-born citizen of the United States means those persons born whose father the United States already has an established jurisdiction over, i.e., born to father’s who are themselves citizens of the United States. A person who had been born under a double allegiance cannot be said to be a natural-born citizen of the United States because such status is not recognized (only in fiction of law). A child born to an American mother and alien father could be said to be a citizen of the United States by some affirmative act of law but never entitled to be a natural-born citizen because through laws of nature the child inherits the condition of their father.

I would love to be a fly on the wall... I doubt even the justices have the nerve to undo this mess.

If they discover that he is not a natural-born citizen it will create a much bigger mess to sweep it under the rug. Questions, or even legal challenges would arise about the legality of any document 0bama signs as POTUS.

I agree 100%. obama didn’t get a case of the dumbass and forget about this little requirement...after all, he taught constitutional law. The goal is to undermine the constitution, treason IMO. The dumbed down electorate sees it as a political trick, in fact the constitution is like an ordinance that can be rewritten or bypassed....I get this from talking with a few about this issue.

obama should be arrested or deported immediately. It will create havoc and I don’t care. There are large segments of the US who need a lesson in the US constitution.

I think we may see all nine justices decide correctly in this matter. At the very least, I don’t expect there will much opposition to at least hearing the case.

I say, “We are doomed” at least once a week, and I usually mean it. However, the fact that there will be a conference about an Obama birth certificate case gives me hope. Only four justices will have to agree that they should hear arguments about the case, and I think at least four will agree to that. If I were Obama, I'd be sweating.

Hawaii may not be allowed to show the birth records, but what is stopping "the one"?

Reminds me of the old song, "Too legit. Too legit to quit!" Does the fraud think that he is above the Constitution? The Democrats and Obi may pull this off, but if he doesn't become more forthright, his administration will be tainted before it begins.

I think if the case has gotten this far, there's something to it. Whether or not they'll be ‘hard’ proof that Obama was born in Kenya, I don't know. But they are several justices that like to use international law to determine cases. So it would be par for the course if the court ruled that Obama wasn't born in the U.S., but that's okay. They'll make up a new law allowing him to serve.

Here's a very specific prayer: that at least four justices agree to hear one of the pending Obama birth certificate cases. If the Supreme Court actually hears one of these cases, I predict the final judgment (either way) will be unanimous.

Yes, Justice Thomas will do the right thing and I am not sure many Freepers will be happy with Justice Thomas after he does the "right thing."

It would be golden sweet revenge against all those who have mocked and ridiculed him through the years, and he can do it by just doing the right thing. God has put his enemies at his feet. Cool.

If Justice Thomas does decide against Obama, and Biden does ascend to the presidency, it would be very ironic. It was Biden, who was Chairman of the Judiciary Committe, who allowed Anita Hill to testify and make her outrageous charges against Justice Thomas that almost derailed his nomination. If Thomas rules against Obama, he would be aiding his former nemesis in becoming President.

And if Obama is as I expect, Constitutionally Qualified to be President, I am sure that Justice Thomas and the other eight members of the SCOTUS will unanimously throw out the case and Chief Justice Roberts will deliver Oath of Office to Obama on January 20th at noon.

And then there will be Freepers who cry and moan that the entire SCOTUS is in the bag for Obama and the DNC.

Donofrio has gone in like a bull in a china shop, concluding that anything the Clerk does which is not to his satisfaction, is due to bias. Now he has put that complaint in the Chief Justice's lap.

It will be denied. And that will be that for the Donofrio case.

So... you mean to tell me that a clerk of the SC can derail the wheels of justice because of some idiotic protocol?

Let's say the answer is "yes". The issue will not go away because some clerk or court applied bureaucratic red tape to kill it. There's no red tape strong enough to keep this genie in the bottle.

If the Supreme Court does not deal forthrightly with this constitutional question, it will fester and de-legitimize Obama's entire term in office.

I don't think we'll get to the mid-term elections without massive protests and acts of civil disobedience, if this is bungled by the SC.
