Supreme Court To Review Obama’s Citizenship

It looks like the Barack Obama citizenship issue will not die until he is inaugurated. It probably will not end even then.

Now the U.S. Supreme Court will discuss the matter in private because one justice decided it was worthy. Before fingering the member of our highest court, I will give a little background information on the case. If you do not think too hard about it, you can probably guess which Supreme Court Justice is responsible.

Leo Donofrio of New Jersey filed suit against Nina Wells, the New Jersey Secretary of State, claiming that she had not performed her duty to ensure the integrity of the electoral process.

Donofrio originally asked a state court to review the citizenship of Barack Obama, John McCain and Roger Calero. Calero was the Socialist Worker’s Party Presidential candidate. He was born in Venezuela. That is a cut and dry case.

John McCain was born in Panama but on an American military base. Legal scholars believe birth on an American military base qualifies as a “natural-born citizen.”  A “natural-born citizen” is one of the requirements to be President.

For Obama, it is the old born in Kenya story again. Anyone who doubts that Obama was not born in Hawaii, please refer to Politifact and Factcheck investigations. Hawaii does not allow birth records to be publicly viewed. This is why no one can go in and see the certificate. It is not because Obama is hiding them, or they were never there. Anyway, after Donofrio’s case was rejected at the state level, he presented it to Supreme Court Justice David Souter who rejected it. Donofrio then presented it to Supreme Court Justice Clarence Thomas who put it on the court docket for a conference on December 5. If four of the nine justices decide to hear the case, then full oral arguments will be scheduled.

Now it is possible Thomas wants to review Calero’s eligibility as a Presidential candidate. There are plenty of acceptable reasons for this. However, the timing, 10 days before the Electoral College meets, only gives hope and ammunition for those who believe Barack Obama has conspired to create the greatest hoax in world history — that he and his family have been hiding his Kenyan citizenship since he was a few days old so he could run for President.

By the way, for those still questioning Obama’s and McCain’s citizenship qualifications, al-Qaeda did fly planes into the Twin Towers, aliens have not abducted millions of people for medical experiments, and the moon is not made of cheese.

My understanding is that there is no other choice -- if Obama is ineligible, Congress must give the presidency to the guy who collected the second highest number of Electoral College votes. That would be McCain.

Here's a good "What If"...what if the Supreme Court orders Obama to prove his eligibility and he refuses to do so and just goes about his business and assumes the office? What then? Does someone drag him kicking and screaming from the White House? Who?

This has the potential to be a second Dredd Scott decision. If there is evidence that Obama is inelibible, but fear wins the day and he gets into the White House anyway, then years from now when people ask a candidate "Can you name a Supreme Court ruling that you believe was wrong?" The answer will involve Obama's birth certificate.

This strikes the heart of the issue -- are we a government of laws, or is the government living in fear of the mob?

It's my understanding that he electors can vote for whomever they wish, except for a few states. The person they vote for doesn't even have to have been running for President. But I would bet they would vote for Biden as a way to make it fair to Democrats and to quell the chances of a riot.

That will be worth the show all by itself. And there is no reason not to take the case, as it is just a question of constitutional elegibility.

Obama did it on purpose knowing full well that if DOES assume the Presidency without being constitutionally qualified that it sets a precedent and opens up the Presidency to basically anyone in the world. The aim was to subvert and weaken the constitution and the United States.

That is exactly what I claimed here about a month before the election - I still stand by that claim, adding that we are doomed.

And when not one of the Justices agrees to take the case, I am sure that there will be threads of thousands of posts here on FR with each post stating that Chief Justice Roberts, Justices Alito, Scalia and Thomas were all in the bag for Obama.

Nope. Before the electoral college meets on 12/15 no president has been elected. All we chose are electors who can vote for pretty much anyone they want (although some states have laws against faithless electors). If Obama is found to be ineligible before then, they'll probably vote for Biden as president and someone else picked by the DNC as VP. If the decision comes down after the electoral college votes, the 20th amendment has the solution:

If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified;

Thus Biden become president in that case too.

A highly respected long time poster at FreeRepublic Congressman Billybob had this to say about the Donofrio suit.

Having spent three decades working with the Clerks of Court, I surmise what is happening here. Donofrio has gone in like a bull in a china shop, concluding that anything the Clerk does which is not to his satisfaction, is due to bias. Now he has put that complaint in the Chief Justice's lap.

It will be denied. And that will be that for the Donofrio case.

Only twice in its modern history has the Court accepted a typewritten, not printed, brief. The second one was mine, and I got that right because I politely pointed out to the Clerk that in US v. Nixon his office had accepted such a brief with a promise to print it later.

You catch more flies with honey than with vinegar. This is a basic truth of human nature that Donofrio has ignored. He doesn't know what he is doing, and he is fouling the nest.

I support all publicity, good and bad, for these goings on. The citizens have a right to be informed. I will say, however, the accuracy of this author’s writing borders on the absurd. For example ... Roger Calero was born in Nicaragua. John McCain was not born on an American military base, but rather, in a hospital *near* an American military base. And, Obama could release his birth certificate of his own accord at any time of his choosing. If Glenn Church actually researched his own material, he might actually come to realize what all the fuss is about.

...Barack Obama has conspired to create the greatest hoax in world history — that he and his family have been hiding his Kenyan citizenship since he was a few days old so he could run for President.

It's more likely that his abandoned teenage mother and her parents wanted free stuff from the government to help raise the child.
